Previous employer threatening me if I join same end client with another company.-- please help
Hi all,
Urgent help reuired, please help me whatever you guys can. My problem
is that I'm trying to change my employers but working with the same
end-client. My previous employer whom I'm leaving is threatening me
with dire consequences if I leave him & join other company & work for
the same end-client.
hhe is saying that this is against the non-compete agreement clause
which I signed 3 years ago & he also is saying that he can sue me &
the mid-client if I work for the same end client with some different
employer.
Please tell me if his threats are genuine or not, can he do some harm
to me or he is just trying to scare me to stay with him so that he
keep on earing his profit on me.
Earliest replies will me highly appreciated as I have to decide my
future compay asap.

without reading the NCA clause in your agreement/contract, I don't think anybody can answer that for you

These are labor law issues, not immigration issues. I suggest you consult
with a labor law attorney, or find a labor law newsgroup.
It seems that the answer to your question depends on the specific wording of
the non-compete provision in your contract.
Also, anyone can sue anyone, and if you are sued you must defend yourself,
even if the case is frivolous and intended to harass you.

I am no lawyer, this is not an immigration issue, but here it goes
If you indeed signd the agreement it should be binding and you can be
liable for damages as specified. Depending on the agreement he may not
even have to go to court as you may have agreed to arbitration as
well. You should finf the agreement and read it, the ones I have seen
stiopulate only a given period where you can't provide services to
past clients (i.e. 1 year)
I suggest you consult with a competent lawyer, this is a employment
issue I believe.
Your new employer can 'buy' off the old one if they choose to, but not
so sure how exopensive it would be. I also heard some people say they
are not enforceable but I doubt that, the Andersen one for partners
was and firms that wanted to hire them had to make payments to
Andersend to release those individuals (it was reported on the
newspapers). Consult with a lawyer and have the agreement available
for review
