Default Police Record / Court Record.

Hello,

I am currently in the process of apply for my K1 Visa to the USA. I have
just received my 'checklist' of required documents which include a Police
record and a court record.

My question is that I have been convicted a few years back of "Driving
without Due Care and Attention", my concern being that this may appear on my
Police record and hinder my progress in getting entry in the US. Does anyone
have any knowledge or previous experience of this? I am not really sure that
a driving offence is classed as a criminal offence or not. I thought it may
not be due to the fact I can have the offence removed from my driving
license after four years.

Does anyone have any thoughts / advice.

Also is it actually required to get a court record for the interview? If so
where is the best place to obtain this?

Thanks in advance,

Rich

The only crimes that can be used for denial of a visa are ones that fall
under 'moral turpitude'
My understanding is that traffic violations don't fall under that category,
so you should be just fine.

Here's a link to the section of the Immigration and Nationality Act that
would most interest you:

ates&fn=document-frame.htm#slb-act212

Here's a link describing the definition of Moral Turpitude:

Hope that helps.

Many thanks for that information, Jim. It does indeed help.
My only other question really is how to go about getting a court record, or
if in fact is actually needed for interview.

Has anyone with 'interview' experience obtained this form / document before?

Thanks again,

Rich

Example of a 'moral turpitude would be failing to disclose the conviction on
your application. Be truthful...

Regarding this issue - I also have a question.
I have no problem admitting to my past-simple possession of hashish ( .5
gram ) at age 20. I'm now 38 and have received a pardon in Canada for this
crime. I know I have to report this as part of a K1 visa in order to be
truthful. Can anyone tell me if this would ruin my chances of moving to the
US to marry a woman there. Thank you for any advice or help.
