POE for a visit, Officer mentioned CR-1?

Default POE for a visit, Officer mentioned CR-1?

Hi there,

Just writing to say that my husband (UKC) just arrived in Philly airport and
went through immigration just fine, as a visitor. He's visiting for three
weeks, and brought with him bank statements, letter from employer and landlord.
He told me that the POE officer said that he should be able to get a CR-1 visa
easy, by just showing up at an INS office and showing his information. First
of all, I don't know what this visa is, or what he's talking about so I can't
assume the officer is mistaken about something.

Oh, our info/situation is that we've filed an I-130 with the TSC, and instead
of going the K3 route, have applied for my visa to live in England with him
while we wait (which is in review but that's for another board).

Does anyone have a clue what this officer is referring to? Just curious,

Are are proceeding the correct. The INS idiot at the POE is just that an idiot. He doesn't know squat about INS procedure and his information to your husband was 100% incorrect.

BTW CR-1 is conditional permanent resident. It is conditional if the AOS interview is prior to your second wedding anniversary. LPR if after it.

Hi Ashley,
When you complete your filing through the Consulate in London, your husband will receive a CR-1 Immigrant visa to enter the US on. It's not *quite* as easy as that POE officer made it sound! The CR-1 stand for Conditional Resident, based on first preference spouse of a USC). When he enters with that visa, he will receive an I-551 stamp in his passport and a hard copy Green Card in the post. the I-551 IS the Green Card, for all intents and purposes. Your husband will not then need to AOS or file I-485 and EAD and all the other jazz of the K1/K3. He will BE a Permanant Resident and will only then need to file to remove conditions 1 year 9months after entry and the Naturalization should he choose.

If you are living in England with Perm. Leave to Remain, or whatever it's called, you may be able to speed your processing time by having your I-130 processed from London (if TCS isn't moving fast enough for you). Look up posts by LD Jones, Roger Pen(n)eycate or the terms DCF London to see what I'm talking about.

Hi:

Although spoken badly -- notionally speaking, you could now file your entire I-130/485 packet with the local INS and also file for advance parole. He leaves once you get the advance parole.

I once had a case like that -- when INS made bad noises later on, I pointed out that he said he was coming for a month and that is exactly what he did -- his filing for the AOS and getting the AP was perfectly consistent with that.
