POE question

Default POE question

Hi everyone,

I need to know what the process is when I land at the POE (with immigrant
visa). I am told that I need to stand in non-citizen's line. I want to know
what the officers need, what kind of questions they ask, do they need to see
some documents (apart from the brwon envelope which I am supposed to give
them)? etc.

YES . You are not a citizen. Long way!!

Your passeport .
The will let you know where to go, what to do. Feel fine, it usually goes well
with no trouble .

From what I've read (and experienced when my wife and I entered the US
with her immigrant visa) the "POE experience" is generally the same:
hand over packet, wait in secondary inspection, etc

If you haven't done so already, do a search through the archives of this newsgroup to get info on POE experiences. It'll give you an idea about what to expect and maybe info on the actual POE you will enter through.

This is also my concern when arriving at the poe. I don't want any more suprises. We had a horrible time at the consulate end (adminstrative review 41/2 months) and would like an easy poe experience. We would hate to have a big problem at poe after a 20 hr flight and waiting for him at the airport . Also not seeing my fiance for a year now would be be unbearable if INS decides we should give us a very hard time.

We have done nothing wrong legally so in a sense we should be alright. But worries creap up on us.

Oh Btw is there a way for me to tell the INS officials that I am there to pick him up. Maybe they will feel comfortable if I am there. I don't know how the system works but I would like to be there with him when he gets questioned.

If one has a valid, unexpired visa there should be no problem at the POE
at all. If it's possible, I wouldn't worry about it too much

I am also wondering about POE problems for immigrant visa holders. We
abandoned a petition only a few months ago, and my husband accrued 84
days of unlawful presence (we filed for AOS before his 90 day free
term was over, but we remained in the country for 84 days beyond the
90 to wait for some kind of word.. which we never received.. not even
a Notice of Action). I wrote to the INS twice telling them we were
abandoning/withdrawing our petition and applications, and we packed up
and decided to move to Holland, but after 6 months, we are wanting to
return and go to school. I am afraid they will see his previous
overstay and other applications. Knowing the INS, they didn't act on
my letters either. I have no way of knowing.

I am assuming that isn't really something to worry about because he
wasn't even in the country 180 days counting his free term, but I
don't feel comfortable.

It also seems that an immigrant visa doesn't truly conflict with any
previous filings. THe POE officers should be able to see that my
husband left the U.S. within 180 days, while an AOS was pending.. but
without advanced parole, which automatically nullifies the pending
AOS. right? If an alien leaves without advanced parole, his or her
applications are considered abandonded/dead? The only issue remaining
would then be whether or not unlawful presence was accrued.. which is
wasn't. So, I think we'll be okay. But if I'm wrong, I'd rather be
corrected now than 3 months from now when my husband faces the INS
officer in Houston.. and a possible ban.
