I would like to ask some questions about h1b1 layoffs. I am on 4th year of h1b1 with LC filed 1.5 years ago. Backlog in oklahoma is 1 year now. My employer gave me notice that i will be laid off in feb of 04. I went to India in end of dec. They paid me till end of january of 04. I came back on 2nd week of april. Now I am not getting paid but they said that they will keep me in status without reporting to INS. Please suggest till when Can I find new job and transfer h1? Also can current employer sponsor for greencard without paying after LC gets approved? Please help me in this issue.

Why would they want to sponsor you for greencard when they are merely
keeping you w/o pay so that you won't become out of status. Beside, to
sponsor greencard, they would have to produce more paper work and so
why wouldk they dop that. Think...man.

They are keeping you in status to give you time so that you can look
for another employer and transfer your h-1 (or get another h-1 however
that htings wokrs).

Hey why not get onto F-1 if you can't find another employer? You don't
know how long current employer will you in statss.

He's not in status as they are not meeting the terms of his H-1B.
It's likely that his re-entry into the USA on an H-1B visa was a
fraudulent and illegal entry, since it was done in the knowledge
that he wouldn't be working or getting paid. This puts him in a
whole world of trouble if the CIS or State Department twig to it.

I was wondering about that.

It looked like he's just doing free work for them in *unspoken*
exchange for their not notifying him to CIS. He'd better get on F-1
or something without waiting. The longer he waits, the more he would
be in trouble, assumignt hat he can get on F-1.
