Pending AOS for F1 Student

Default Pending AOS for F1 Student

I am the USC and my wife applied for the AOS through marriage on an F1
visa in Sept. '02.
We have not had the AOS interview yet. We are applying through the
San Jose office. My question is can my wife quit her studies after
this semester (fall '02) is finished? She is no longer interested in
continuing her studies as we will be having a family soon. What are
the consequences and problems if she quits studying before getting her
Green Card? My understanding is that while processing the AOS you may
quit your studies. Is this true?

Hi Tom,
Once she applies for AOS, she is no longer an F1 student and as a result is no longer required to go to school. I adjusted from F1 and I had my interview yesterday...for some reason the officer asked me whether I was still going to school (I am). I am not sure whether that played a role in his decision (I was approved). How long has your wife been going to school? If she just came for example one semester ago, it may give an impression that she came with the intention of abandoning her studies and getting married to a USC.

When your wife applied for AOs, her status changed at that point to
"pending AOS". She is no longer F1 status, and as such, does not have to
attend school to maintain status. She must remain married to you,
however, to maintain her basis for AOS .

She has been going to school for 3 years now so that shouldn't be a problem.

I have kind of a similar situation.
My wife is on F1. I am working on H1. My employer is sponsoring my GC and I am adding my wife as a dependant so that she can get her EAD. She graduated(MS) this month. She has 1yr. of OPT.

What will happen if I want to sponsor her for AOS? Can I do that? What are the options??

Please let me know.
