Default NSC, I-130, time line

Has anyone had their I-130 approved lately? How long is it really taking?

Yesterday, the NSC updated the timeline for our I-130 application.

It is now 315-345 days (up from 290-320).

Since our 1st NOA was July 1, it has already been 370 days....50 days longer
than the time posted.

This information has always been grossely wrong. However, posting times that
have already elapsed is plainly illogical. Yet they alos did this the last
time they updated with new longer wait times. The new updated dates had
already passed.

Can anyone comprehend how this can happen. If a human is doing the posting,
wouldn't they recognize that they are posting nonsense. It just makes more
work for them as people call in to find out if their application is ready
based on this misinformation.

As Matt Udall and Mr F have stated in the past, the amount of time that they give for processing times are not binding nor reliable. Conventional wisdom says to look at the current processing date to get a better idea (still not perfect) where you stand.
According to Matt's website NSC is currently processing applications with a June 3, 2002 date.

Well, I'm sure there are alot of reasons.

In our case, we weighed the options but felt that his being Egyptian & Muslim & 29 (back when we were discussing all this) weren't in our favor for a quick process regardless of which petition we filed. Add to that our age difference, time necessary to get to know his family and culture, time for him to learn English and me Arabic and, at that time, a religious difference (I've since converted). Plus, everything we read then said a spouse visa took about 6-9 months. Because I travel internationally regularly, we felt we would have opportunities (which we did) to see each other during the waiting time so it didn't seem that bad. On top of that, when we started this, it was shortly after 9/11 and I reasoned being married was better for us under the circumstances (I've since learned this is totally irrelevant). Finally, our romance had been a sort of whirlwhind courtship and waiting 6-9 months didn't seem that unreasonable and, we reasoned, would bode well for us in the long run (I could just here the interview going something like this, "you've know each other how long? You were engaged after six months and one visit? Right. Hmmmm....").

However, as time dragged on and I found this NG, I realized quickly that the NSC was, if anything, going to move slower not faster, thus we filed for the K3.

I've asked myself if I'd do anything differently and about all I'd do is to file the K3 sooner rather than later. When I first learned about the K3 it was shortly after I filed the I-130 and no where on the Internet or the BCIS (INS back then) could give me any idea if it was any faster than just waiting for the I-130. Since I wasn't keen to spend another $110 without more confidence in the outcome, I didn't file a K3 last year.

I don't know about the others, but that's why we did what we did.

We were advised to do this by a lawyer.

Because of the massive difference in time that it is now taking between the
two routes, (that developed over this last year) we are kicking ourselves
daily.

Our lawyer thought it the best route because of some nasty attitudes among
certain paper pushers in the I-129 route. When we started the process it
looked like there might only be a month or two of difference.

We've been married six years now. I moved to my spouse's country for the beginning of our marriage so a fiance visa would not have worked for us. Besides, last year, when we filed, the I-130 was not this slow. It was only about 4-6 months for NSC approval. Today, it's much longer of course (in fact today's our 1 year anniversary from our NOA1 date).

We too are about to pass the 1 year mark since filing our I-130 but now that we are together again thanks to me getting a K3 visa the wait doesnt really bother us too much now but will be so glad when all of this is behind us. Going by the current processing times I would say we still have a long wait ahead of us.
In the mean time its on with more paper work & waiting etc while we wait for the EAD & look at AOS etc. Seems its never ending but at least the stress isnt the same as it was when we were living worlds apart.

Easy answer - no choice.

My daughter was not eligible for a K-4 was I was not eligible for a K-3 (I had already filed for AOS in the US).

So for my daughter the I-130 was the only way to go, the only "quick" route available being DCF for which my husband would have had to move to the UK.

My 1st NOA from NSC is 5/15/02. We were excited last October when the report came out with a processing date of 5/16/02. Unfortunately we still haven't heard anything yet.

For what it's worth, my attorney's office contacted NSC on Friday and were told that they are presently processing 130s in 14 months. I really don't put much faith into that comment since in the past we were also told that they were processing in 8 months, 10 months, 12 months and 13 months.

As previously mentioned the website states that they are currently processing applications with a June 3 2002 date. Your application falls before that so how have they skipped you? Makes one realise that nothing is reliable & only a guideline but not a very good guideline at all is it?
