I know a lot of you are aware of this situation; I got this post at another
website. The exact quote is below. PEOPLE! you need to write your Washington
DC offices Senators and your Congressmen, call them all the time; make them
"staffers" your friend "if that's possible" You pay taxes, you vote, you are
an American citizen - get mad!

Asylum petitions should be divided within the Service Centers, not having
YOU! the US citizen get to the back of the line, so someone from a country
the US government claims is "preferential" to you and your love.

I have ****ing had it; Yes I said ****ing had it. 157 days! maybe another
three months. Pick up the phone and make the case; you the tax payer, the
voter, the American, is having his life put on hold because of obvious
political maneuvering.

Time to get mad, and pick up the phone. Do not have some intern take notes
when you call; Demand to speak with an LA "legislative assistant", Chief of
Staff, whatever, do it! Write letters! do it - You and I can. NSC is blowing
us off, because this Administration (GW Bush's) is looking at us as a
potential leak of terrorism; or simply, people who will wait because they
have no choice. Yes we do!!!!!!!!!!!!!

"As the Senator's representative, I am in regular contact with the Nebraska
Service Center. They have informed me that the BCIS office in Washington,
D.C.
has mandated that they adjudicate 10,000 asylum adjustment applications
before
October 1, 2003. They are the only service center tasked with these
applications. As such, the NSC has moved many of its' officers from
adjudicating
fiancé and spouse petitions to adjudicating the asylum petitions. Once these
applications are adjudicated, I understand that the Nebraska Service Center
will
be readjusting their resources back to fiancé and spouse petitions, among
others."

You come across as quite selfish in your diatribe. You are being quite favorably treated and yet you complain that YOU are getting screwed. Why don't you complain about the whole thing.

23 years ago, Congress passed the 1980 Refugee Act -- people who have ALREADY been granted asylum can apply for green cards after one year. However, unlike marriage visas -- Congress put a 10,000 annual cap with a use-it-or-lose it provision. Unlike asylees, marriage visas have NO annual cap. Also, preference visas [including other family visas] DO have a carry-over.

Now to keep control of numerically limited applications and maintain a WAITING LIST [and I mean WAITING even if NSC had instant adjudication], those applications are centralized. They have 120,000 of them. Remember I said they could give out 10,000 per year? Well, NSC has NOT been doing that and over 20,000 visas went UNUSED, never to be "recaptured." And for every unsued visa, not only was one applicant delayed, but everybody behind them.

Well, this is not a sudden thing -- it is a CONSTANT requirement that has been in place for over 20 years.

You've been waiting 157 DAYS -- well, listen up -- NSC got SUED for their incompetence and as this suit is progressing, there is a District Court judge fuming about the NSC FUBAR and they are at least trying to get done what they should have been doing ALL ALONG. Take a look at the NSC processing times and look at I-485 asylum based processing times.

They've been waiting for YEARS and you complain about days?

Also, you ARE a US citizen -- you've got a US passport and you can travel to see your beloved. Those asylees have been found that they risk their VERY LIVES if they go home -- take a look at he I-730 line -- that is to get the asylees' families here. Note that delay -- and quite often those family members are in the country their loved ones had to flee for their lives.

BCIS has, indeed, screwed up, screwed up big time. I'm mad at them. But you just come across as a selfish self-centered person.

I am sure that every government and their officers are the same. making force on them just stop their asses to move and all answers that we may get and actually we have them like : "wait.... be patient.... we have another work which we must finish" It is like pushing car up hill. It is heavier then hman anyway
Don't think that I tell about doing nothing. We should write and call, but I look at all results and see nothing, but only crush of hope to have help. Don't think that i am not optimistic. I am, just being realistic

Folinskyinla, you should understand our frustration. Actually you do, but don't you think that nature of people are selfish by itself??? I am sure that all asylums would like to tell the same what we tell to other kinds of petitions. Yes, they are waiting, but whether we should blame people who is far from loved ones and who is fed up with all this? Who is crying and show the self side?? I am sure not!!! It is expression of own frustration. It is expression of own feelings which are not directed against of Asylums, but against of all rules which are and which are really unfair!!! The question is: who may change this? I guess you know who so such words about selfish fiancee petitioners and poor Asylum will sound better in other place!!! So I think you make only more pain stating again and again words above. Yes, Asylums suffer, but we are also and if I am not mistaken we are on us-mariage visa Forum.

Olenka who has only 1 day before having 7 months with NSC, whose fiance calling to Congressmen, to NSC has the same answer: "BE PATIENT!!!! BE PATIENT!! " How long I wonder???? Other 7 months

I am still pissed at your accusations, so yes, you bated me with your
elitist ways, liberal-legalisms. What makes you think I can travel to my

You seem to be confused. He is talking about Asylum. This is not about
overstaying a 90 day visa. Asylum is not something that is easily given,
especially not in post 9/11 BCIS. There is often a possibility that a
person seeking asylum can not go back to their home country without
risking a death sentence. As he has said, these people have been
waiting years because INS/BCIS has not been processing them like they
should be processed.
This man has been VERY helpful in providing free legal information to
this forum long before you have arrived. I can assure you that his goal
is not to piss off people waiting for their loved ones, but to inform
people that there are other people qualified to get visas unrelated to
marriage. Under the law, they are just as entitled to the visa process
as your loved one is. You are not MORE entitled.

Sorry man, but it doesn't matter if you are a, "a natural born citizen, tax payer, law abiding man."

Your fiancee still is no more entitled to a visa than a refugee. It is not your inherit right as an USC to brink a foreign bride into the country.

I'm sorry that you have to wait in agony for your fiancee, but that is a risk that you, myself, and anyone else with a foreign fiance(e) knows they are taking when they begin an international relationship.

I think you get the idea that I DO share he frustration. Also, I have a selfish tendency to wish that BCIS would do MY CLIENTS first. But I know that "just ain't fair". I happen to hate the tone of the BCIS response to the good Senator. But we have a "lifeboat" problem here -- rather than railing about the problem that exists and that it should be fixed -- Todd comes arcorss as "throw the other people overboard!"

Many, many years ago I had a government job -- due to conscription I served in the US Army [IOW, I didn't follow the "**** the draft" mentality]. I was quite fortunate to do all of my service Stateside.

I remember my wife telling me about being at the checkout line at the commissary while I was gone for all of three weeks and a woman in line asked her "how long before your husband comes home?" and my wife answers "two weeks" and she gets a response "oh, you are so lucky, my husband has 4 months left on his [one-year] tour in Vietnam" whereupon another woman sighed "count your blessings, mine was KIA."

I'm afraid your selfishness wouldn't play all that well outside of Ft. Stewart, GA.

Todd - I understand you're frustrated. I'm almost at 190 days now. We're still waiting, and we were told it'd probably be another 40 days. You have a right to be angry with the process - we all are. I've got representatives and senators tracking down our petition...

Step back. Perspective. I have friends who were married, and separated 3 years without seeing each other (no phonecalls, some letters...) until he could bring her to Canada. If he had returned home to Algeria, he would have been jailed, or killed. 3 *whole* years. He hasn't seen his parents in over 8 years now, because he can't go back, and they can't leave. He wishes he could pull his younger sibling out, but can't. Not without someone getting jailed, fined, killed or otherwise "disappeared".

I'm gonna be waiting over 9-11 months, all told, to get my visa. I've been able to visit my USC fiance in October, November, December, February, he came to Ottawa in March, I was back in May, and now I've been here visiting since the end of June and won't go back until September...

What the hell am I complaining about? What the hell are ANY of us complaining about? Sure, other service centers aren't quite FUBAR up to this extent and are approving petitions in less than one month. Yep, we don't live in their jurisdictions. Sucks, really. But it can't be helped. That's perhaps what we should be complaining about: fair and equal treatment for PEOPLE and FAMILIES - just so we're on the same footing as businesses, school and tourism.

We have a right to be frustrated at how the system *is* FUBAR. That's a legitimate complaint. However, asking our representatives and senators to put *us* before *others* just comes across as being selfish and self-centered. The Us versus Them mentality goes against everything the United States wishes to stand for, when it claims to be the land of opportunity, and of the free.

We're not alone in this, as K1ers and K3ers. There are other *people* involved. With families. With their own share of pain and hurt. Consider yourself lucky: you feel you've been done a great injustice, and you are allowed to complain about it. You can write your senators, your congresspeople, your president, you can contact the media, you can make as loud a fuss as you want. Those asylees can't - they're treated as second-rate individuals (by you, too)... who come from lands where "speaking your mind" about such injustices would land them in a ditch, somewhere, with a pile of other dead bodies.

Exercise your rights and freedoms to complain loudly about the injustice you're suffering. Just don't walk all over people who, in so many ways, are less fortunate than you are.

Maybe this all makes me a nasty evil person, but just remember that I'm going to cross that 190 day line soon. I've been waiting, too. And I'm going to continue to wait. Sure, I'm tired and fed up, but there are people out there in far worse situations than me and my fiance. No, that doesn't mean we don't have a right to complain about the fact the process is FUBAR (and we did, in a way, by asking our reps to look into things for us)... but it doesn't give us the right to claim importance over other equally deserving people.
