No expiry date in I94 given at POE

Default No expiry date in I94 given at POE

I got my H1b stamped in Canada couple of months back. I got a new I94
when I entered US after stamping.

Recently I went to India and handed over all the I94s i had. While
entering back again, I was given a new I94, but this one didn't have an
expiry date. I asked the officer and he said it is not needed as the H1
visa has the expiry date. But all my friends (we went together) had an
expiry date (either visa expiry or passport expiry which ever is
earlier).

Should I have an expiry date or is this fine?

If I shoudl have an expiry date what should I do now?

The officer was wrong. All I-94s should either have an expiration date, or
say D/S. In the case of H-1B, there always should be a specific expiration
date, and it should usually be one of the following:

- - six months before the expiration of your passport (for most nationalities)
- - the expiration date of your passport (for some nationalities)
- - ten days after the expiration date of the petition.

There are two approaches you can take: live with it and take him at his
word. I think this would be reasonable.

Or you can get it fixed. To get it fixed, you would have to visit your local
USCIS office and ask for deferred inspection.

I would suggest you call the attorney who got you the H-1B in the first
place, and ask what he recommends.

I'd suggest calling and going to the nearest port of entry or CBP deferred inspection office. You should have an admit to: date.
