G-845, Document Verification Requests

G-845 Responses Instructing "Continue to Process As Legal Alien"

Do not process an SSN application from any SSN applicant if you
receive a G-845 response with Item 11 checked: "Continue to process as
legal alien. BCIS is searching indices for further information."

BCIS has informed us that in such cases, BCIS needs to update the
applicant's BCIS records. Therefore you should tell the applicant that
he/she should contact BCIS to have his/her records corrected/updated.
You may leave the SSN application pending until the applicant returns
with new/corrected BCIS documents (which will need to be verified with
BCIS) or the SSN application drops off the system after 120 days.

Resolving Discrepancies Between BCIS Documents and SAVE Online Data

EM-02091 dated August 2, 2002, instructs FOs to submit a G-845 to BCIS
when there are any discrepancies between an applicant's BCIS documents
and SAVE online data. There are no tolerances to be applied; BCIS
prefers that all discrepancies be verified via G-845.

Continue to pend the SSN application while you await the G-845 reply.

Once you receive a G-845 reply verifying the applicant's status, you
should process the SSN application based on the G-845 reply. (The BCIS
status verifier may or may not address the discrepancy in the G-845
reply.) BCIS will ultimately correct its computer records, having been
alerted to the problem by the G-845. You should not return the G-845
reply to the status verifiers asking that SAVE online be corrected,
nor should you delay processing the SSN application until SAVE is
corrected.

Verifying Change-of-Status Cases

SAVE online is not quickly updated with new status information when a
nonimmigrant's status changes from one class of admission to another,
e.g., B-2 to F-1. Therefore, when an applicant submits an I-797,
Notice of Action, with a tear off I-94 showing the new status, FOs
should immediately request verification of the new status via the
G-845 process when the new status cannot be verified via SAVE online.
There is no need to wait until 10 days after the status has been
changed.

Submitting G-845, Document Verification Requests, to BCIS

There are several things that you (Field Office) can do to help BCIS
respond to your G-845 requests:

-- Provide clear, legible photocopies of the documents to be verified.
Annotate the photocopy with the relevant information that BCIS needs
to verify the applicant's status, e.g., name and A-Number or Admission
Number, when you cannot produce a clear photocopy.

-- Indicate if you are submitting the G-845 because there is a
discrepancy between the INS documents and the information on SAVE
online.

NOTE: The BCIS status verifiers who respond to your G-845 requests are
not able to enter or correct data in any BCIS database or system.
Therefore, DO NOT return a completed G-845 to the status verifiers
asking that they enter the data into SAVE or other database.
