Default New letter, thanks fatbrit

Talked to Brian, cleaned it up a little based on your input and some
corrected info, etc. What do you think? Also, what is the best way to send
it, email (easiest response for them, can attach their email response, and
can send Sunday evening), FAX (will require waiting until he returns Tueaday
and may wait until the end of the first work week, necessetating some minor
revision on employment statement), or snail mail (extreme likelihood of
loss, hence request to send easily replacable certified copies of paycheck
stubs instead of irreplacable originals)? Should it be addressed to the
Immigration Supervisor? Thanks for all the intelligent and useful
responses.

Dear Sirs,

I write to ask that you reconsider my wife, Abigail Dobony's, visa #
LGS1234567890 since I do not understand why it has been refused. We have
acted in good faith to attempt to fulfill all the written requirements for
her visa based upon USCIS web site information, application information,
your office's information and my immigration attorney's advice.

I have a proven track record of gainful employment dating back to my last 2
years in high school.

I took a leave of absence from my job before coming to Nigeria. Your office
sent an email dated Tuesday, March 8, 2005, 4:27 am, to my attorney,
assuring me that if I returned to Nigeria you would not reject her visa on
the grounds that I currently working since my parents had sufficient income
and capital to sponsor Abigail.

I contacted my current employer on Wednesday, June 8, 2005 and I am
returning to work the day after returning to the United States. I will be
working for $7.50 per hour, for 9 hours a day. With overtime considered I
will be earning an annual income of over $18,000, not including additional
overtime when the plant goes back to 10 hour workdays.

My parents have already pledged financial support for Abigail. Their
combined income is almost double the required minimum income. They also have
abundant assets.

In addition, they have stated that they will post a bond if required.

Again, my wife and I beg you to reconsider your decision to require I return
alone to the United States and work for an additional 3 months before
granting Abigail's visa. Abigail is in no danger of being a public charge,
as a review of our financial documentation will readily demonstrate.

If you do not reconsider your decision I would request that Abigail be
permitted to bring certified copies of my new check stubs instead of the
requested irreplaceable originals, due to the serious problems of the
Nigerian mail system. In addition, in lieu of total reconsideration I
respectfully request that you consider the 2 months I already worked this
year while in the United States from January 2, 2005 to March 19, 2005
towards the requested 3 months employment as this is continued employment
with the same company.

Thank you for your time and consideration in this important matter.

Sincerely,

Brian Dobony

In Abigail Dobony's possession:

Copies of my pay stubs, bank statements, credit card statements, auto
registration
Copies of your emails stating you would not reject my application if I
suspended my employment and returned to Nigeria
My parent's affidavit of support
Evidence of my parent's income and capital

Shouldn't that be" on the grounds I am NOT currently working"

Also mentioning when your son is leaving for the US and the date he will be returning to work.

should read: I do not understand why my wife's visa has been placed on hold.

It has not been refused.

Unneccesary

I took a leave of absence from my job before coming to Nigeria. Your office sent an email dated Tuesday, March 8, 2005, 4:27 am, to my attorney,
assuring me that if I returned to Nigeria you would not reject her visa on
the grounds that I currently working since my parents had sufficient income

Again, her visa has not been rejected but placed on hold for additional documentation.

I contacted my current employer on Wednesday, June 8, 2005 and I am returning to work the day after returning to the United States. I will be
working for $7.50 per hour, for 9 hours a day. With overtime considered I
will be earning an annual income of over $18,000, not including additional
overtime when the plant goes back to 10 hour workdays.
Overtime has no bearing on the amount required for meeting the financial requirements. Delete all references to O/T.

should read: I will be returning to my former position as a factory worker at an hourly rate of $7.50 with a 40 hour work week.

My parents have already pledged financial support for Abigail. Their
combined income is almost double the required minimum income. They also have abundant assets.
Parents cannot pledge. If income is used, delete references to assets.

Should read: My parents have completed an I-864 as co-sponsors for my wife and their income well exceed the requirements for a family of 4.

In addition, they have stated that they will post a bond if required.
Completely unnecessary

Again, my wife and I beg you to reconsider your decision to require I return
alone to the United States and work for an additional 3 months before
granting Abigail's visa. Abigail is in no danger of being a public charge,
as a review of our financial documentation will readily demonstrate.
Delete the word "beg"

This paragraph might be better to use and should be the last paragraph: It is my hope that you will reconsider your decision regarding placing my wife's visa on hold. As our future financial situation seems to be the basis for your reluctance to grant her visa, I sincerely hope that the attached letter from my employer which outlines my employment and salary, along with my parent's I-864 will be sufficient documentation to ease your mind that my wife would become a financial burden to the citizens of the US.

If, however, you still require that I return to the US without my wife in order to meet the employment requirements you have recently manadated, would you please advise me how best to get the paystubs to you without having to go through the Nigerian postal system. Can they be sent directly to you via international courier or can Abigail hand deliver certified copies to you at the Consulate?

If you do not reconsider your decision I would request that Abigail be
permitted to bring certified copies of my new check stubs instead of the
requested irreplaceable originals, due to the serious problems of the
Nigerian mail system. In addition, in lieu of total reconsideration I
respectfully request that you consider the 2 months I already worked this
year while in the United States from January 2, 2005 to March 19, 2005
towards the requested 3 months employment as this is continued employment
with the same company.
Reworded above.

Thank you for your time and consideration in this important matter.
I wish to thank you for the time and consideration you have given us on trying to obtain an immediate relative visa for my wife. I'm fully cognizant of the fact that the instance of fraud is high in Nigeria and understand your need to weed out the fraudulent petitions from the legitimate ones. If I can be of any further assistance in eliminating your concerns, please do not hesitate to contact me.

Sincerely,

Brian Dobony

The I-864 speaks of annualized income, not hourly wages. Figure out how to calculate 7.50/hour into real money.

I know it's a typo, but just in case Mike is copying this word for word, that part should read:

....my wife would *not* become a financial burden....

I agree... and it's probably not a good idea to slam another branch of the government... ie, the postal system.

Hey... Mike... if you're reading, delete the "to attempt" bit when you say, "We have acted in good faith to attempt to fulfill all the written requirements..."

Rete, I am beginning to change my opinion of you. This is GOOD! Still need
