hello:

My employer has been laying off people for strange reasons. Also, he is
not been paying us on time. I did not get paid for january yet. i don't
know when will i get paid for jan.

Hence to be sure that my legal status is not affected - I applied for a
new h1 transfer with a new employer. I have 2 questions though:

1.> Since i didnot get paid for Jan - My attorney said that he will
file for H1 transfer with my 2005 W2 and "maybe" December paystub. Do
you think my H1 will get rejected because I don't have January paystub?

2.> Can I continue working with my current employer and keep the new H1
as backup - and join the new employer whenever I get laid-off from my
current employer? Is there a time frame - as to when should I join new
employer after getting H1 approval?
