Hi,

I am working in the US on a H1B visa. Yesterday I got layedoff.

I am in the process of securing a job with another company (Company
A). I was told informally yesterday from my to be employer that I should expect the
appointment letter in 3-4 days(after the backgroud/reference check).

My problem is I have only 10 days grace time to stay in the US.

Is is OK to stay here if I send the documents for Visa transfer within the next 10
days and if the new company can only file for the Visa transfer after the 10 days.
Will INS consider that legal. Some one told me that there is something called
maintainence of status where one needs to file the transfer within 1 month of the
grace period. can some one advice me on that.

A friend of mine told me that he can file for my Visa transfer through his
company(Company B) within the next 10 days so that I can be in a valid status.

I have a question here. If Company A also file for transfer of my Visa will it be
legal.(I assume since my Visa is already in the process of transfer through my
friends company it is not a overstay for me)

Please I need advice from you guys from your experience and knowledge. Should I go
for the second visa transfer at all?

reply greatly appereciated.

-Ni
