The L-2 is a derivative visa. All you need is proof of your (then) spouse's valid L-1 visa, and a copy of the marriage certificate. Easy peasy.

And furthermore, an L-2 is much easier to obtain than an "accompanying domestic partner" B-2, which was an executive interpretation (presidential order, not enacted legislation) designed to to circumvent the restrictions on derivative visas only being available for spouses (and children), which, prior to gay marriage made it impossible for a same sex partner to obtain a visa to accompany an H-1, L-1, O-1, etc. Unless you have a drug habit or a criminal record, obtaining an L-2 or H-4 is pretty much a formality.

"right to work" is about not being forced to join or pay union dues. I believe you are thinking of "employment at will"

So am I right in saying that if we were to marry here in the US, I can apply for a change of status here and I would not have to return to home to do so?
