Hey all.

Posted couple of question on this site couple of days ago. it was
helpful so i thank you all agin.

i needed some help in filling form 130 and 765. some of you -i know-
will think it is so silly to ask such questions but i dont want to
submit without filling the right information.

on the I-130:

question 22:

"complete the information below if your relative is in the USA and will
file for i485: your relative is in USA and will apply for adjustment of
status to that of lawful resident at the office of the INS in city
(space) state (space)......"

i am a resident in las vegas and will continue to be resident in las
vegas after applying 485. I will be filing to chicago box. do i fill in
chicago IL or Las vegas NV? am confused because my file will transfer
eventually to las vegas's INS office.


form i-765 (EAD):

questions 14 & 15:

"14: Manner of last entry: visitor, student...etc"
"15: current immigration status: visitor, student..etc"

now i will be filing this form concurrently with 130 and 485. what do i
fill in number 15? i entered as a student so 14 is answered, but dont i
have to put "pending immigrant" or "spouse of USC" or something like
that for 15? or should i fill in "student"? am confused because all
forms are sent togather and i want them to know that i am married to a
US citizen, other wise they will reject my application since students
are not allowed to get a permit.

to re-phrase my question: how can they process the 765 based on
marriage if all petitions are filed togather and not yet approved??

any help is appreciated.

Pending adjustment to permanent resident.


The I-765 is conditional on filing the I-485... approval doesn't matter at this point. If the I-485 is ultimately denied, the I-765 will become invalid.

Yep, "Las Vegas" and "Pending AOS" are your answers.

The I-765 is based on your current filing of the I-485, which you are doing at the same time.

guys thank you so much. i knew it.. i had a feeling that writing down
"chicago" and "student" is kinda wrong.

I so much appreciate your help.

I'll fill the forms and i will definitly seek help from you guys if am
stuck again.
