Default Need Format for I-751 Letter of Affidavit

Hi all... It's been almost two years since I've been in the news group, my
and I filed through the Sydney Consulate in July of 2001 and I doubt I could
put a $ amount on the support/advice I received through this news group.
Angie and I are about to file to have the temporary residency status removed
and I was hoping someone in the group could help me construct the letter of
affidavit I need to provide attesting to the validity of our marriage. I
have already lined up three willing friends but I need help writing the
letter itself as I'm uncertain as to the form and can't seem to find
anything out on the web. Does anyone have or recall the format they used?
Any and all help is much appreciated..... thx )

Bob,

There is no prescribed form or format - only a required content, which is provided in the I-751 instructions.

Write a paragraph of one or two sentences each to discuss each item of information required.

Hi:

Read the instructions to the I-751 carefully -- the affidavits are NOT required -- they are simply listed among a list of documentation that would help.

I do NOT submit such affidavits. As far as I am concerned, such affidavits are the weakest form of evidence and are essentialy useless.

Hi, welcome back.

It is more important to have evidence than affidavits. Affidavits are for
those who have little evidence.
I would say most folks submit the I-751 without affidavits.

-Joint tax returns, or separate returns from the same address.
-Loans or utility bills showing both of you listed.
-Have you had any children?
-Envelopes from everyday correspondence addressed to either or both of you
at the same address is evidence.
-Spread the stuff out so it covers the entire two years if possible.
-Actual letters from folks or "official business"addressed you the both of
you...doesn't have to be about the marriage.

You get the idea. Everyday ordinary stuff that shows an honest legitimate
marriage. Its easy. Its not like trying to convince someone you didn't
commit a crime or anything.

Phew, never expected to get so many respoinses so quickly. Thanks loads
though... I'm one of those worry wart type's..... should have seen me
preparing file the I-130 and financial support docs!!!!!!!!!!

Since my husband and I are having our AOS interview within 8 months of marriage I have most of the above. I however hesitate asking for affidavit letter from friends and family as they don't live near us and we've had little interaction with them. I personally don't feel that affidavit from friends/family has much weight as evidence.

But this is what I do have:

-Two bank accounts in both names same address
-Husband as beneficiary on my 401K, life insurance
-Lease in both names
-Car insurance for both of us, one car
-Letters written from family addressed to both of us
-Joint credit card, well okay I'm the primary he has copy of card
-his selective service card with our address
-Driver's lincenses with addresses on them
-Change of my maiden name to married name same address
- Medical/dental bills and medical insurance him on my insurance
- His paycheck with our address on it
- Cell phone family plan my name on account, him with the other phone and pages and pages of us calling each other everyday.


Is that enough? Do you think I would still need the letters? It would be complicated to put the (landline) phone in both of our names so I have decided not to.

In our experience with the AOS interview in Arlington, the only thing the the officer was really interested in was the most recent tax return with both are names on it (state and federal showing we filed "married filing jointly"). We took all sorts of "evidence" with us to the interview (ie. bills, deed to the house, picutres of our wedding and pictures of us since we got married, etc.). I had two copy boxes full of stuff that we hauled down there with us, and that was wayyyyy too much stuff. It was a pain in the butt to lug all that stuff with us, but I wanted to be prepared for anything. All it left us with was hurt backs!

Do you have tax records that you guys have filed together? My only advise is to take those with you, and maybe a few picts of you guys together.

We are talking about "Removal of Conditions" in this thread, not the AOS
interview.

For the AOS, consider you are trying to show you have a bonafide
relationship, and you didn't just "get married for the greencard". You have
a really good list, IMHO.

For the Removal of Conditions, you are showing you have "maintained" this
bonafide relationship over a two year period.

Oh yeah, I forgot to note that but we do have 2002 tax year filed jointly, and then I have the other years as single.

Thanks for the clarification. I am glad I know what I have to look forward to in about two years time...for the removal, if regulation and process don't change too much.
