If an explanation attempts to mitigate a persons involvement in an incident does it then become an excuse ???

Not sure what context you were referring to. It is the defence attorney's job to try and get the best possible outcome for his/her client. The fact that, in this case, she has nothing to grasp but straws surely cannot be held against her.

ANYWAY... ... I'm not holding it against her I'm simply putting it into the context of why she is saying what she said as an expert witness of the defence. The defence's reason for her saying it is to convince the jury that he should not get the death penalty. That's their job I'm not saying it's wrong I'm merely taking the prosecution's stand.

Seems to me like the defense are really grasping at straws.
If any of the jury are under 30 there is a big possibility that they have also come from a 'broken' home.
However I doubt any of them became a religious nut with intentions to kill.
I think this will ultimately backfire on him, it jus gives the impression that the defense are playing the "I had a horrible childhood thats why I'm bad" card.

He wants to die, so as he can become a martyr to his sick cause.
Therefore, I suggest that he should be sentenced to life in a Colorado Federal Maximum Security Prison, where it gets extremely cold in the winter.......with music from the likes of Danny La Rue, Max Bygraves, Val Doonican & George Formby etc piped into his cell 24/7.
He can spend the rest of his miserable life, being guarded and told when he can and can not eat by Infidel Guards.
Also, his family would have a hell of a job, travelling from France (no rifle-dropping jokes, please) to Florence, Colorado to visit the guy.
Any thoughts???
