Default Missed Biometric Appointment I-765

Hi there,

Due to the most stupid of mistakes, I missed my appointment for biometrics to renew my employment authorization card I-765.
I was in a PANIC, because my current card was about to expire and I missed the appointment not just for a day or two, but for THREE weeks. The appointment letter, in capital letters, says that if you miss your appointment, your application is considered abandoned, period. Calling to the misinformation number, they told me to send a letter asking for a new appointment....that would have taken weeks, and my current card would have expired by then.
Luckily, I learned through some messages in this forum (God bless Google) that people in similar cases were able to have their biometrics taken just by showing up at the ASC with their (late) appointment notice.
That's what I did. I live in New York City and the ASC is on 201 Varick street. They allow walk-ins every wednesday for all late appointments, they take your biometrics, no questions asked.

Don't you think you should thank the ASC too for being flexible and allowing
you to still take the biometrics late for no good reasons ( stupid mistakes
in your words)?

People crucify CIS for the negative but give no due credit for the good
things done.

I have no reason to thank any INS agency for, and I sincerely doubt I will ever have. Actually, it is very much the contrary.

Yes, I missed an appointment. My reasons may have been stupid, but there are kazillions of reasons why someone can miss an appointment like that. Most of them just as stupid as mine.

What still puzzles me is that you receive an appointment in your mailbox, which is a mean through there is no guarantee at all that you receive it, yet you are threatened on it by INS that your application will be denied if you fail to show up. They are very careful to not mention that there is any possible way on Earth to change or reschedule your appointment. None has asked you if you can make it on that date. You can be abroad on a business trip, or in delivery labor, or.....but it doesn't matter, you will be threatened with your application to be denied. It can be your green card, your employment card....whatever. Calling to the misinformation number will be as useful to talk to a wall. Much worse, since looking and talking to a wall can have a relaxing effect, while the answers at the misinformation number will drive you up the wall in less than a minute.

It is very nice that ASC have these Wednesday walk-ins, but it was just by chance -googling the internet- that I knew that such possibility existed. Apparently, it is a piece of information that we, the applicants in need of those services have officially no right to know about. Should I thank them for that?

What would you have done if all CIS offices were really that strict and
would stick to what they have stated in the paper without giving you the
flexibility to report as a walk-in? They don't have to give you another
chance without a good reason why you missed your appointment. It is
discretionary. Some people don't even get that chance.

What have the U.S. owed you for your presence here?
You don't have any vested RIGHTS in law to immigrate to the US or get any
benefits from the US! You are just a guest of the American people and their
government, remember that!

You need to take that big ol' stick out of your butt! It is a matter of record that ACS's are far more flexible than other USCIS offices. I would have been surprised if they said, "No, make another appointment!"

Actually .......

The request for MY presence in the USA comes from my wife, a US
citizen, simply requesting that her husband be allowed to live in, and
contribute to, the USA.

The role of the USCIS is, at least in part, to expedite such
reasonable requests made by it's own citizens. They are, in fact, the
servants and not the masters.

My wife is increasingly discouraged by the peremptory demands, and
threatening tone of the very letters complained about in this thread.

The US may owe me nothing, but they owe her, and a little civility in
the way they do the job would be appreciated.

Is that a reason to avoid personal responsibility on you part? Are you
saying you were just pressured by your US citizen wife and was not acting in
your own volition to be in the US? That is weak!

If I remember right you are the one who missed the appointment due to stupid
reasons which you have admitted. Isn't that contrary to letting them
expedite the process? Don't you think that you have contributed negatively
to the situation?
USCIS is not perfect and it will never be even if you could be made a part
of its system. Don't be too unreasonable with your expectations.

Civility? Has any USCIS employee abused you or treated you in an uncivilized
manner? They even allowed you to have the biometrics taken out of your
appointed time which you missed for no good reason, right? You should have
appreciated that.
What has the US owe your wife anyway ? May you let us know?

I haven't missed anything at all.

I simply read the thread, and the comments reminded me of things my
wife has been saying every time this Govt department makes contact.

It's a great irony, that a country with some of the friendliest, and
most courteous people on Earth has a beaurocracy that is simply rude
and officious.

You guys may have those among you who think immigrants should be
grateful for any crumbs from the table ....... however, where I come
from, we tend to be actually MORE polite to visitors, than we might be
to people we know well. I am sure that in your own families,
workplaces, etc, guests are treated with rather more respect than
USCIS can manage.

Then they are inhumane to expect people to put their life on hold just
for this appointment.

Then people would give a good excuse instead of beign honset about
stupid mistake.

Why change the subject? He made a good point that none of these
appointment letter ask or state the option to reschedule. And he has
rights, rights for resceduling which was not stated to him in the
letter. That is why you see a lot of people coming here ot this forum
panickenly asking what to do if they miss an appointment. IF USCIS is
concern that more people would miss the original appointment, they can
establish rules like, if you don't reschedule within a week, you will
have to wait for 2 months or so before you can rescedule. There are
ways to treat people with respect.

USCIS is so incompetent that they tried giving the option to initiate a
Biometric appointment (this was a while back when I was applying for
AOS) and when we call them right after receiving the letter to do so.
we get told that it's booked up for the next 40 days and they wouldnt'
take an appointment and said to call again. Each call takes 30-40
minutes being put on hold. I called again not even the next day but
the next week and the same thing. So I asked about neithboring cities
within driving distance. The same thing.

So I raised a question "what am I supposed to do?". I asked for any
where in my sate and that I would fly and that's what I did. So I flew
to and back the same day just for the appointment. Costed air fare, car
rental, and a lunch. Fortunately, the location was close to the air
port and I did't have traffic problem and save gas expense but I lost
my favorite white summer cotton jacket ( to fend off the heat) at the
air port waiting area. No one turn it to lost and found. It got
stolen, obviously and this is not even Int'l Airport. So this finger
printing costed me about $300 aside formt he fees for it.

I learned that I was one of the last group who had to call and make
the fingerprinting appt. They change back to the old procedure
assigning the appt and only if people can't make it, they reschedule.

Because they are privately contract and they work effciently.
