Hello All,

I need your advice. I've been browsing through this NG for a while, and frankly I had
no idea that immigration process would be so hard . At first I got scared, "Green
Card" movie flushed in front my eyes. So here it goes:

Background: I've been in US approximately 5 years now: F1-Practical training-H1B I
met my wife about 3 years ago. Last month we got married.

This is what we do not have:

1) I moved out from my apartment and moved with my wife, since her rent was
substantially less than mine. However I can not be put on the lease, since we
live in a rent controlled city and landlord hinted that he would alter the
lease... we do not want this to happen. So I am not going to be on a rent
agreement. In a long run we plan to buy a house, however this is not gonna
happen soon.

2) My wife does not have a drivers license and does not know how to drive (she
walked to her work all her life and never needed a car). So she is not going to
be on a car lease and car insurance.

3) Both of our employers pay for out health insurance, so we keep separate health
insurance. We are listed as an emergency contacts and as a beneficiaries,
however. We do not work for the same employer.

This is what we have:

4) Joint bank checking and savings account
5) Joint credit card account
6) We are listed as a beneficiaries on our retirement plans (we have separate plans
through our employers)
7) We are listed as an emergency contacts at our work
8) Various joint memberships, etc..
9) Photos well before the wedding, wedding pictures with both of our parent present
and pictures after the wedding
10) Various letters, post cards and invitations addressed to us at the same address
11) I receive all of my professional correspondence at my residence, I am licensed
in my state.

We are going to have:

12) Joint tax return for 2001 (we got married at the end of 2001)
13) Letters from our neighbors and friends stating that we live as a married couple.
We also can get letters from our parents in law.

Any suggestions will be highly appreciated.

You have ample proof so you won't have a problem.

You must live in New York City or thereabouts. I have the same problem with my landlord as my lease is for a rent stabilized apartment. However, I was fortunate enough that when it was up for renewal the management company allowed my husband's name to be added as a tenant. But it wasn't necessary for INS since they are familiar with this problem for the area. (Note if you are in the NYC area, a listing of who occupies the apartment must be made to NYS housing authorities. This is done usually when the lease is renewed. Ours is renewable in a few months and I just completed the form for NYS last week.)

Also we have separate cars. We each own our own vehicle but do share one policy. Our health coverages were separate too because it was cheaper that way. Our respective companies pay coverage for a single insured and we would be liable to pay a large portion to cover "family".

Your checklist is almost identical to what ours was and we didn't have a problem and I don't forsee that you will have one either.

I'm going to second Rita's opinion and say that you have plenty of proof. Some people
look at these checklists and think they must have everything but obviously that is
not possible. (Having said that, I think I will be able to have every single item on
the Arlington checklist if they ever give me my interview date!).

Andy.
