Hi, I've been here for more than 10 years, never had any problems with the law, got health
insurance, we have a young son (born here), run my own business... yet we are completely
illegal. We basically arrived on a tourist visa and stayed overtime. What are the chances
or options of applying for a legal status. I would love to pay taxes, however I do not
want to risk being deported. Is the fact that we have a son that was born here any legal
advantage at all? Is the fact that it has been more than 10 years any advantage?

Couple of things:

1. You should be able to change your status to that of a legal resident because you have
your own business. However, there are some criteria you have to meet and I dont know
the specifics. You should talk to a good immigration lawyer and he/she should be able
to give you some sound legal advice.
2. You might be able to take advantage of the new LIFE act passed by Clinton. Again a good
immigration attorney should be able to help you here.

Although I am not a lowyer and dont have much immigration experience, I think that you
have much better chances with option #1 if you meet the criteria.

Perhaps this is your biggest problem. If you have had an income here for 10 years but
never paid any taxes and then you appear out of the closet.......
