Leaving Canada without surrendering I 94

Default Leaving Canada without surrendering I 94

Hi,
I have asked this question in canadian immigration forum but thought to
ask here as well as it may be more relevant to this group.
I am permanant resident of Canada. I am on H 4 status (H4 approval
notice with expired F2 visa stamp on passport). I came to Canada
without surrendering my I 94 about 2 months ago. I took off from Canada

to India and no body asked me to surrender I 94 (and I also did not
know at that time). Now I am back to Canada. I know that I stayed more
than 30 days outside of US so now I have to get US visa stamp in
passport. My question is
What should I do as no body asked for my I 94 and I still have it? Will

that be a problem during the visa interview that I am going to schedule

at the US embassy in toronto?

If you have left the United States and are still in possession of the I-94 or I-94W it is in your best interest to forward it to the appropriate authorities so that your record is corrected and that you do not experience any problems on future travel to the United States as a result.

It is very important that you complete the back of the card listing the port of departure and date of departure from the United States and the carrier/flight information. The I-94 or I-94W together with a letter of explanation and evidence of your departure from the U.S. should be sent to:

ACS - USCIS, SBU, P.O Box 7125
London KY 40742-7125

Thankyou verymuch for this information. I have at this time two I 94.
1. The expired one which I was given to me when I came first time in US
on F2 visa.
2. The most recent one which I received along with my approved I-797
(H4 status) notice.

Do I have to send both or just the recent one.

When you seek admission to the US next, give them the old I-94 with evidence of when you departed the US. Train/plane/bus ticket stubs, credit card transactions etc could help demonstrate when you left.

Also, the back of the I-94 states that you must surrender it upon departure. It doesn't say that anyone will ask you for it when you leave.
