Lay off after I-485 filed more than 180 days

Default Lay off after I-485 filed more than 180 days

Hi,

I need help on my current situation. I was laid off recently and I
filed my I-485 on this March, which means it is already been more than
180 days. My questions are:
1. Do I need to be employed until I get my green card?
2. If I receive a RFE from INS to requst my pay stub and employment
evidence, but I still do not have job, what should I do if I want to
get my green card?

Hi,

I don't believe you need to be working while waiting for AOS
(I-485) unless you are the person who sponsored your spouse
via (864 form and 864a) and not vice versa, for more I'd check
the INS website.

Yes, you must be working "in the same field". Don't worry about a short
period of unemployment, though.

Tricky. You may need to ask an attorney what to do in that case.
