I would ask your boss to say that the company's need for you to move to the US requires them to follow USCIS requirements and not her recommendation. It may, unfortunately, require him to take it further up the chain of command (have his boss talk to her boss, for example) to get traction.

Yeah that is how I read it too. I find it quite astounding that somebody can go around disseminating false information ("18 months minimum") without even redacting her original statement; if I hadn't have read up on the L1B as much as I have, I may have taken it for face value and given up.

My prospective manager and his manager are very highly ranked so I am quite confident that they can overrule her recommendation...given that they can point to fairly black and white immigration law.

I am just concerned now as to what extent I would have to go to prove that I am 'specialised'? Are her concerns regarding the heightened levels of L1B scrutiny accurate?

Since you ask - the requirement is 12 months, and anything over that neither adds nor detracts from the application. I believe the 18 month recommendation is total bollocks - and you can tell the person I said so. If they have a problem with the way the requirement is worded, she can take that up with the US government.

I suggest that whoever hired her should fire her - because she's turning an otherwise fairly straight-forward application into a farce. She clearly doesn't know her arse from a hole in the ground (as my sainted mum used to say)!

No more or less than any other visa requirement.

Just to correct this, you CANNOT extend your L1B past 5 years. Only an L1A can be extended to a maximum of 7 years.

In order to get an L1B converted to a Green Card it requires a lot of work. You will need to have your company advertise your position in several mediums and interview candidates for your position. The company then needs to demonstrate why none of the applicants were suitable for the position.

An L1A will convert much cleaner into a Green Card and please remember you don't need to be a manager of a team, you could be a manager of an internal process that would make you eligible.
