J-1 change of status to F-1, I-20 form
Hi, I have some problems with my visa status. Maybe somebody could
help me.
I am on J-1 visa now. Au-pair. it expires in March. I want to study at
one NY university starting in 2003 September. First I wsa told I have
to apply in January and I will get the anser in a month or so. Now I
found out that they don't issue I-20 form until August. Then they
explained to me this form won't be valid until August. But I need that
form before March so I could send all the documents to INS before my
visa expires.
Is there any way I could solve this out? Does the validity of I-20
form in August mean that I won't have even a copy of it just so I
could show to INS that I was accepted? What should I do?

You could change to tourist status to bridge the gap, although that can be
problematic for such a long time. The other option is for you to return to
your home country until you get the I-20, and then apply for an F-1 visa.

You could change to tourist status to bridge the gap, although that can be
problematic for such a long time. The other option is for you to return to
your home country until you get the I-20, and then apply for an F-1 visa.

Thank you for the answer , but now university told me they will give
me like a copy of I-20 or itself, so I could send the foc to INS. But
now I have a question if I really can stay in US and don't have to
come back home to wait as there was some kind of law issued about
that. I talked to INS and a woman told me that I can stay in the
country. Is it really true?
I can not go back home as they won't give me visa there.

You can indeed remain in the US as long as your change to F-1 status is
filed on time. This means that you must file it before your J-1 expires.
Also, if the J-1 has the 2-year home residency requirement, then you would
have no choice but to go to your home country and get a visa (it probably
doesn't apply to you, as an au-pair).
