interview question

Default interview question

Just got notice of my AOS interview in Atlanta on the 9th (filed Jan
01) and have some questions. I was told that I must bring a completed
and notarized I-864 to the interview. One was filed with the original
paperwork, do we still need to fill out a new one? Does my husband
need to come with me to the interview? There is no mention of that in
the instructions. Also, the instructions that accompanied the
interview letter state that we must have a letter from the current
employer while the instructions with the I-864 state that a recent pay
stuff is sufficient? Which is correct? One last question, can my
wages be used as part of the household income or is my income exempt
because I am the person applying for the AOS?
Any help would be appreciated. Thanks Jennifer

If you have been married long enough to have gone through a tax filing period that was not included with the original I-864 then bring that to up date the original.

If you go the interview without your husband, you will NOT be approved. The interview is to validate your marital status. Without your husband there for them to question, they cannot validate it. Suppose they don't mention it because it is a given ;-)

As for including your income on the I-864, you can do that if you have lived in the household for 6 or more months. Your husband would complete a new I-864 and you would complete the I-864A. Note, this is not required if your husband fulfills the financial requirements for the I-864 on his own.

Hi Jennifer,

In fact, I have a question that is very similar to yours. I realized
that I dont have with me a copy of the original I-864 we filed at the
time of applying for AOS. Now, do we need to file out another one and
take with us at the time of the interview (our interview is in 2 weeks
in San Jose INS) or will INS have a copy of the one I filed earlier.

I had the same thing regharding the I-864.
Just didn't bring it and nobody asked.

Don't know what to tell you.

I do believe you have to come both. That is what that
interview is really about. They want to check if you guys
are really married. They look in the marriage album and such.

Mainly it is about the Affidavit of Support that your hubby
had to fill in earlier. If that one looks OK then there is
no problem. I was not asked about my personal circumstances,
while I was unemployed. My wifes affidavit (not stunning)
was enough.
