Default Interview Help!

Hello Everyone,

Okay, so i have my interview to move back to america with my wife on wwednesday. My Lawyer has put together all my documents and i have two questions on them if anyone can help?

1. The america certificates say its a felony to copy? but lawyer has copied, is this ok, just the embassy site said it needs copies?
2. I dont have originals of my wifes bank statements as they are electronic and downloaded from the internet and printed, will these be ok? oh and the taxes are copies as orginals are with the the tax people?

Can anyone tell me what to expect at the interview? do i go into a room and get grilled, does it take long, i am hoping it will be quick as its 8.30am?

Any help will be useful

Yes.

oh and the taxes are copies as orginals are with the the tax people?
Yes, photocopies of tax returns are OK, as long as you include the ENTIRE tax return, including earning statements (W-2, 1099, or whatever the UK uses as end of year earning statments).

Can anyone tell me what to expect at the interview?
There have been many write-ups of DCF interviews here, I'm sure...have a look around.

do i go into a room and get grilled, does it take long, i am hoping it will be quick as its 8.30am?
You don't go into a room, no. You go up to a window. You will be asked a few things, probably not "grilled" as you put it. Not sure how long it takes, maybe depends on how many other people are there...but I'd plan on a few hours at least.

Thanks for that, i will take a look around for the info.

As for certificates its her mums birth and our maraige!

Thanks, just a worry, one last thing if you can help, my wife filled in taxes for 2009, but she was here, so done it and was $0, does she need UK tax stuff as i am worried now she will and we dont have it or is the 2009 taxes ok?

A photocopy of her 2009 US tax return is needed. I assume since the amount was zero, that she wasn't working at all in 2009? So I'm not sure what you mean by "UK tax stuff". If her US tax return showed zero income, then it means she wasn't working.

It might be a good idea to also include the previous 2 year of tax returns as well...2008 and 2007. If she was not required to file a tax return for some reason, for those years, she should write an explaination as to why not.

Is she using a joint sponsor on the I-864, or is she using assets?

We have taxes for 2007 and 2008, but read due to being here in 2009 and its $0 we would need say p60 (uk tax), but we dont have that as she was temping all over the place!

Her mum is a co-sponsor for us as we have paid off all we owe here so we have a clean start!

Bring copies of all 3 tax returns...2007, 2008, and 2009. Bring whatever you have. If the ConOff needs something more, she will let you know.

Good that you have a joint sponsor, make sure you bring her I-864 and all supporting evidence and tax returns as well.

I'm still curious, if she was working temp jobs in the UK, why is the income on her US tax return zero??

Wally, please explain what your wife filed for a US income tax return for 2009.
If she was living/working in the UK, she still completes a US income tax return, showing the income she earned in the UK (P-60), tax paid, subtract the treaty etc.
If that sum comes out to zero US income, that is OK. The UK income would not continue in the US, and can't be counted toward meeting the I-864 requirements, but as long as she correctly filed her 2009 US income tax return and has a Joint Sponsor, that's fine.

She should have included that information on her US income tax return. You don't need to bring it again; it is irrelevant for your support.

Hello Guys,

If i am honest i have no idea how she filled this in, i know she had until the end of june or this month to do as she was here, all i know is the lawter put a $0 on the tax form, we sent off about 7-10 weeks ago and not heard anything back from them.

So i am not sure is she filled it in correct as i have no idea how it works, can this mess my application up?

Just checked i have a 1040 form filled in and a 2555ez form, so looks right??

Can you appreciate how frustrating it is for us to read these posts, where you are asking potentially important questions, but don't have any of the information? This is why you (all, collectively) worry about things. The simplest thing to do would be to ask your petitioner if she filed a 2009 US income tax return, first.

Yes, that is a US income tax return. If you had a US immigration lawyer's assistance, you should be pretty confident that he would know, yes?

Try not to worry. There seems to be an overabundance of worrying going on here this week.
I haven't read of a K or CR-1 visa denial out of London around here in ages.
