Dear Expats

Iam unmarried son of US citizens parents and my petition for greencard is under process. I have one elder brother who is in USA on H1b visa. Since my all family members are in USA can I apply for visitor or student visa to USA?

I thought that having US parents made you a Yank automatically?

Yes, you can apply... but be prepared to either have the visa denied or you being denied entry to the US. Your GC application coupled with your whole family being in the US, makes you a strong candidate to stay in the US in likely violation of the visa.

Apparently his parents are naturalization and no it does not entitle him to US citizenship. If they naturalized while he was under the age of 18 and he obtained permanent residency status him before his 18th birthday, then the moment he became a PR, he became a USC as well through his parents.
