Default Impact of withdrawing L-1B EOS petition

Hello,

My L-1B's due to expire in February. My wife and I don't want to return to the UK for consular processing just yet. So we were thinking we'd have our employer submit an EOS petition to by us an extra 240 days and then when we book an embassy appointment later in the year we can just withdraw the EOS petition and attend the visa appointment.

Any negative impacts on that withdrawl? I don't want it to count against me in the future.

Just out of idle curiosity, what visa category will you be seeking at the consulate? You don’t say. If I was tendering advice, that would be something I would need to know.

Oh, my mistake. Should have clarified. It would still be L-1B and L-2

What? Your question presupposes you would no longer qualify for L-1B visa issuance. “It is a puzzlement.”

I'm not sure what you mean. I'm not pre-supposing that I won't qualify for L-1B visa issuance.

How long have you been on L-1B? My L1 stamp is valid for 5 years but the inital I-290S was only valid for 3. For my renewal, it's done via EOS and then a new form being issued acording the attorney, rather than requiring an embassy apointment etc.

Yep, I know it can be done via an EOS. I covered that in the original post.

I was asking for any perspectives as to whether withdrawing that petition would have any negative effects if I elected to go for consular processing whilst it was still pending.

PostBox poses a fair point. It is one of the reasons your inquiry puzzles me. Perhaps you should pose your question to an immigration attorney who will be able to review your situation and engage in the appropriate dialogue to give an answer to your inquiry. As things now stand, it is impossible to answer your question.
