Default I765 Denied

Help me please. Here's my situation.

I entered thee US from the UK on a visa waiver last year, i met a girl who i fell in love with and then i had to go home because my 90 days were up. I came back over to see her again and we decided we didn't want to be apart so we got married. Now i never came here with the intent to get married (never had intent to get married full stop) but thats what happened. We got married in July of last year, around a month before i was due to return to the UK. We filed forms for green card and EAD back in september and after a few returns for wrong addresses i had my biometrics back in January. Got a letter in yesterday saying that my application had been denied because i entered on visa waiver and don't have an alien registration number. We have yet to have our interview for green card and i am now worried sick that i'm gonna get denied.

My wife, ever the optimist thinks that once we have the green card i can apply again for EAD and that we just made a mistake of filing before we should have. I'm just worried that if i was denied for one thing maybe it'll affect the other.

I can't help about the denial, but anyway, once you've got the greencard, you don't need the EAD... You sure it wasn't an RFE? Perhaps a word with a lawyer could be prudent... www.ailalawyer.com for a referral.

Either way, you don't really provide enough info on exactly what's what for people to help you.

It says that i was denied because i didn't enter the US under the K3, As i entered as a visitor and i have not received my green card, my status still says visitor. It wasn't an RFE, it also says that this decision cannot be appealed.

Thanks for all the recommendations, any ideas why they would've came to this decision? Its got us both pretty shaken up.

By entering the US on the VWP, you signed away your rights to an appeal... one of the reasons why people shouldn't do what you did.

If you have an AOS pending you are eligible as long as you entered legally. Sounds like they have not hooked up the I-765 with the AOS. Check on the back of the cancelled check for your case number and then check it out on the USCIS website. Did you mail the I-765 at the same time you mailed the I-485/I-130 and other documents?
