i485 Help

Default i485 Help

Hi Everyone

As you know by now, i've decided to file all the paperwork for myseld f (can't afford a lawyer!)

I have my I-130, I-485, I-765, and G325A's.

A few problems that I am having...

I don't have a copy of my birth certificate (it's in the UK...somewhere)

I do however have my passport (expires Jan 2006)
My I-94 (expired Nov 2003)
UK drivers license

I do have a US Social which is stamped with 'Only Valid with INS authorization' (I was originally here on an H2B)

I'm confused with a few things (Rene has helped me out alot-thanks for that!)
On my i485, Part 2 Application Type, I dont know which one to tick. I'm filing all the forms together, but I have overstayed my visa (see previous posts) and am now married to Sara, who is a USC. Do I tick (h) and write down that I have married a USC?

Also on the I485, Part 1 'Current USCIS Status', do I put 'undocumented'?

I am sure that I will have more questions, and as you all understand I really want to get the paperwork in asap.

Also, just to let you know that I think you are all wonderful people for sharing your knowledge, and once my immigration journey is complete I will stay a poster on this site to help out others as you have done to me...thank you.

Assuming the H2b was your last valid visa, maybe 'H2B - Overstay'. Undocumented sounds more like you entered w/o inspection.

Hi PDS,

For Part I, I'd put H2B (expired). Your overstay will be forgiven since you are now married to a USC.

For Part II, I'd mark (h) and write "Marriage to US Citizen".

Do you have someone in the UK that can get a copy for you? If they go to the office where you were registered they can get a copy of the register. Doesn't have to be a relative anybody can ask for a copy.

I have this link http://www.gro.gov.uk/gro/content/ for ordering copies online. I don't know if you can get them sent to the US but if not you can always get someone to receive it in the UK and post it to you.

Well, actually you are applying because your spouse is also filing I-130 "that will give you an immediately available immigrant visa number, if approved", together with your application, right? So, I'd check (a). Marriage to USC in of itself is not basis for adjustment of status -- filed I-130 by USC spouse is. I was adjusting from F-1 based on the marriage and I checked (a) and everything was fine. Of course, I might be completely wrong on this one.

Even easier than that. I got my sons' long form birth certificates by ringing up the Registrar of Births and Marriages where they were born and they mailed them. All one needs is a credit card to pay for them.

Wow! I had no idea you could do that. I didn't know about the online thingy either. My poor grandmother had to make several trips to the Registrar for me. She's a lovey though and didn't mind a bit.
