What happens if someone loses the I-94 and leaves the US without giving i
back to the immigration?

They would assume that you stayed too long on the previous visit until such time as you proved to them that you didn't.

Presuming this person left the U.S. prior to the expiration of the I-94, and that he or she plans to eventually return to the U.S., the person should begin accumulating evidence that he or she timely left the U.S. in order to avoid an allegation of overstaying. The person should retain any travel or flight itineraries, and any other evidence proving departure from the U.S. Documentation evidencing activity in the person’s home country from the time period immediately after the person left the U.S. would also be helpful. For example, credit card receipts, a letter from an employer stating that the person returned to work, or payments of utilities, etc.

If you have left the United States and are still in possession of the I-94
or I-94W it is in your best interest to forward it to the appropriate
authorities so that your record is corrected and that you do not experience
any problems on future travel to the United States as a result.

It is very important that you complete the back of the card listing the port
of departure and date of departure from the United States and the
carrier/flight information. The I-94 or I-94W together with a letter of
explanation and evidence of your departure from the U.S. should be sent to:

ACS - USCIS, SBU, P.O Box 7125
London KY 40742-7125
USA
