How long did take after you filed to receive Notice?
I filed on 9-28 this year with my attorney, I hope they send the I-90
to correct card to the right Benefit Center after they changed the
procedures on September 8. :confused:

Default I-90 biometrics fee refund

I applied for I-90 replacement card. I received a notice from National Benefit Center (formerly Missouri Service Center) stating that biometrics capture is not required if the replacement is due to:
1) New card has never arrived;
2) New card has not been received due to USCIS's admin's error.

I didn't received my card since USCIS put the wrong address on the envelope. The address change was made in April ( I have proof), but the card was sent to my former address in July.

I-90 instruction says the $70 biometrics fee cannot be waived in any circumstance (I didn't pay $185 appl fee). But I don't understand what the fee is for? Should I (or Can I) ask for a refund of the $70?

Didn't think anyone got a refund from USCIS...so good luck...would be interested to hear if you do though

Just checked the I-90 instruction. It was revised on August 24,2005 (after I filed). New instruction says that $70 biometrics fee is no longer required if filing due to USCIS admin error. faint!

I will have to forget about the refund.

Thank you for the info JQL

I hope they did send it to the right Service Center, because when I
went to their office to sign the I-90 the assistant attorney told me
that I don’t need to send my GC with the supporting documents and
that she is going to send just a copy of my GC.
Then I told her about the new changes and she gave me this weird look.
She told me that she is going to keep my GC and that if she does not
need it she would call me back so I can go and pick it up. She did not
call me so I assume that they send the GC with the I-90. I am not sure
if they knew about the new changes. I don’t know what to think of any
more the only thing I can do is just hope everything would go the way
should be.

My questions are:
What if they send the I-90 to the wrong Service center would USCIS
transfer the case to the right center or they will deny my application
because of that?
It’s been 4-5 days and I still have not received my Notice would they
send her to my Attorney or to my address?

About two months. But you should receive the receipt within days. I filed in early August.

If you went through your attorney, they should know the change and sent your application to the service center directly for expedited processing. You don't have to pay any fee if the error was due to the CIS.

I got another mail from CIS's MSC. They transfered my file to NSC which has jurisdiction over my state. Initial receipt was issued from somewhere in CA, then went to MSC, then NSC. So many transfers for making a card. I looked at the NSC's timeline, I-90's priority date is Feb. 8.

The USCIS doc says if you file i-90 after May, and replacement is due to CIS's error, you can call the national help line 800 number to ask for refund. I called the number, and you know what, wait time is 30 mins to speak with a rep.
