I-864 Please Helpppppppp !!!! Very Confused :(

Default I-864 Please Helpppppppp !!!! Very Confused :(

Hello All,

I have a few questions about the I-864 Affidavit Of Support.


My wife dose not meet the 125% poverty line so we are using her
Father, My Father in Law as Co-sponsor. I'm a bit confused about this
part of our petition and have been since day one when I downloaded the
forms.


I know we have to fill out an I-864 for my Wife and my Father In-law
so my questions are as follows: -

When I come to Part 4.D and I'm filling out Her Individual income for
the most recent tax year, which is below the Poverty guideline, I'm a
bit confused as what to do when I come to Part E.

In part E it asks DETERMINATION OF ELIGIBILTY BASED ON INCOME. The
options it gives dose not apply to my wife's income as she dose not
meet the 125% or the 100% poverty Line requirement, so do I leave
this section Blank or Do I When entering her Income for the year also
put her fathers income, add them together and get them to complete and
sign the I-864A Contract Between Sponsor and Household Member, so on
both my wife's and my father in laws , both I-864's will Meet the
Poverty Guidelines and have the same total Household income figure .
My father in laws income alone is above the 125% Mark I'm just
confused since my wife's dose not and I'm wondering how to go about
Filling out both I-864's and do I have to fill out a I-864A.

As I said I'm pretty confused about this part of the process and I
hope I have explained myself fully and it makes sense in what I have
said above so someone will be able to clarify the process and help me.
I'm running out of time before my Wavier on my Passport expires (30th
December 2002) so I'm stressing about it, which dose not help when
trying to figure this out.

Mick,

Your wife fills out her I-864 form with her info. Only her info.

In Part E, she is *subject* to the 125% rule. Doesn't matter if she doesn't meet the guideline.

Your FIL fills our his I-864 form with his info. Only his info.

You FIL and MIL fill out an I-864A if they will be using both incomes to complete the I-864.

Thank you so much for your help you have saved me from having a
Coronary!!!! And have cleared up my issue with this for me almost.

So when I'm entering my wife's information and its comes to Part E do
I leave it blank or put N/A or none, or do I put a note that my FIL is
Joint Sponsor?

Mick, you just HAD to make me look this form up again, didn't you?

Part E is where you save them brainwork. Fill it out completely thus:
#1: you're subject to 125%
#2: Number of people from 4C, line 5
#3: year=2002, $ amount = whatever the poverty chart says
This is basically just a statement of fact. Nevermind that your wife doesn't meet it.
Part F: fill it in with zeroes if you have no assets to show.

You'll see as you start to correctly assemble the total I-864 with its evidence that your FIL's joint sponsorship is going to slot right in there, no need to attach a note. If mailing or dropping your forms off, you may want to write a cover letter detailing what they will find inside your packet.

An aside here, I may hate myself later but...do you have ANY assets at all? Money, stocks, property? If so, and you two have been living together for 6 months or more (in the UK and US), you MAY be able to contribute. If not, forget I mentioned it and get this form over to your FIL to complete.

Folinskyinla gave you some very good advice yesterday. Maybe your wife can hit the phone books and find some free legal advice for you two, just as a back up to double check your forms. You are torturing yourself more than average, understandably. I know in our household that am more capable of effectively dealing with the American bureaucracy, terminology and quirks of form filling (banks, agencies etc) and my UKC husband understands the UK way of doing things (very different!). Ask your wife, your FIL or other American friends if they can help you interpret.

Thank you so much for your time on helping me with this; you don't
know how much I appreciate it. I don't have any assets or the like
back In Ireland, I had not much except a motor bike which I already
sold so now worries on that.

Yes the other guys gave me good advice and I looked into the Chatloic
Charities and no joy , the other thing is My Wavier expires on the
30th of this month so we don't have much more time and we want it to
get to the INS office a day or so before that expires.

I've been filling out all the forms myself and as an Irish man it was
very alien to me the process and especially the Affidavit of Support
and with my wife been pregnant , I tried my best not to trouble her
too much with this as she has a lot on her plate with the pregnancy
and working also .

My father in law is back in town tonight, he works away in Europe and
around the world most of the year so he will be able to check over the
affidavit of support for me , the rest of it I found pretty straight
forward and I'm confident with , I'm pretty confident with the
petition as a whole now especially with the info you have given me
thanks again.
