I-539 Denied due to abandonment.
Timeline of events.
I was on a H1B(second one) since Mar 2001, got laid off by employer in
Apr 2003, and filed for I-539 extension to B1 a day before the layoff.
(I asked for 90 day extension)
Almost immediately I got another job, and the new employer filed for
H1B transfer (about 60days gap). I even got this H1B stamped on my
passport. My lawyer never cancelled the I-539.
In May 2004, I took another job (current employer), new employer filed
for H1B transfer and this got approved too.
During this time I moved between 3 states. Today I get a notice saying
that The I-539 filed in April 2003 is denied due to abandonment.
"On july 12, 2003, the USICS requested further evidence and granted
the applicant a 12-week period in which to submit the requested
evidence. As of this date, there is no record of a response to that
request.. Therefore, it is ordered by the Director of the California
Center, that the application is denied due to abandonment."
I never received the request, must have missed the mail during my
moves.
Is this something I should worry about? After 4 different jobs I have
my dream job, and want to keep my records clean. My 6 years will end
May 2006.
