I-485 + Resident + Tuition Fee

I-485 + Resident + Tuition Fee
I am residing in Georgia for the past 5 years, Both my wife and I had
filed for I-485 and waiting for our Green Card.My wife has got her EAD
as well. This year she was accepted in one of the Georgia University.
The problem is she was not accepted as an In-State student and the Fee
for Out-State is 5 times than that of In-State !!!.
The University says that
1) I have to be a permenant resident for her to be eligible for
In-State tuition.
2) And they consider my wife as a H4 visa holder even though she has
filed her I-485?
Please let me know if there is a way around this.. Thanks

Universities can make their own rules about who they accept as in-state
student.
They probably have their policies online. Check that.

Universities can make their own rules about who they accept as in-state
student.
They probably have their policies online. Check that.

Hey I found out from someone at university that this instate tuition
fee entitlement is federal. It's not even with just I-485 pending.
It's for I-130 pending as well. In Texas, it seems that it was
enforced only when the State Legislation came out. In fact, in Texas,
H4 holders get instate just as H-1 holders.
If I were you guys, I wouldn't give up at all. I think the university
is being dirty. Find the law or legislation and show them. May be
contact another university to find out where to get hat info. I would
say it would be available online. May be you can share the info once
find it.
Let the people at your school know that you won't give up that
easily.

Even I read that the policies are unique to that institutuion and the
highest level it can be appealed is to the university's president?

Institute at a well known university.
At the time, I was occupied with the info of the class I needed for a
friend (greencard pending and hence do not ned to be on F-1 to take
any class at the university) but later I became curious to find out
whjat year did the law came out. I just didn't get around to call her
again to find out...

Well, I do know for a fact that the rules at least for Institutions of
Higher Education in California are specified in the California Education
Code, Part 41, and not some federal regulation.
