my uni emailed me tonight to say they hadn't received copies of my I-20 and i-94. Except I went there on the 4th Jan and they photocopied them. According to my i-20 the latest I can check in is the 22nd Jan (of course I've already done this but obviously they've lost the copies). So does this mean I'm now illegal ? I will be going down tomorrow to kick ass but where do I stand ?

If you have the original documents in hand, how could you be illegal? Just bring another set of photocopies to them. Unless I'm totally missing something, it doesn't sound too bad.

It says on the i-20 I am supposed to have checked in by the 22nd. As far as USCIS are concerned I have not (cos these idiots have lost the docs).

I agree with Rene, don't worry -- just make sure your school has the correct documents. The only way this would be troublesome for you is if they reported you on SEVIS as not having checked in -- which they're legally obliged to do if you actually hadn't appeared, but they're obviously chasing you first.

ETA: what I mean is, the only way USCIS would know you hadn't checked in would be if the school told them.

When it comes to immigration issues, I'd be cautious about trying to "kick ass" with your university international student office. Be polite and firm, but don't try to pick a fight with them. At some point in the future you might need to grovel to the same person whose ass you kicked because you need a huge favor.
