I-140 approved, I-485 pending - changing job?
Hi,
I filed through my employer for I-140 and I-485 in July 2004, and my
I-140 got approved in January 2005.
I also filed for I-131 and I-765 and got them apporved back in August
2004.
I would liek to change job now. Is this a problem? Would this
jeopardize my I-485 application?
Please advise.

As long as it's in the same profession and position, you wouldn't have a problem. However, you better have a job when it's time for the final interview or else they'll deny your case. Don't quit your current job unless you have another one lined up in the same field and preferrably title.

That was a quick approval. Do you mind if i ask which office you filed at, and did you use an attorney etc?
My mum filed in Aug 2004 and we havent heard anything yet.

I picked up on one sentance that really caught my eye, and must concern many people.

Are you 100% sure about that ? I think cases are adjudicated on the basis, whether you were only just laid off, or have been out of work for weeks/months maybe. What if you have been continueosly working right through the process, (right now anywhere between (3-5 years), then get a red card from your employer a couple of weeks prior to being called for your interview. Your case and everything is now just a matter of timing. I'm sure there are cases out there like this. Especially in I.T. where jobs are disappearing at a very fast rate. If that's the case, then we might as well declare this Employment Based method to getting a Green Card, one big gamble especially for I.T. workers. Gambling on whether you will have job when decision day approaches.

sure, glad to help. Here are the details of my situation:
- I am from France
- my employer (an IT firm in NYC) filed for a GC on my behalf back in
Oct. 02 (I had been with them for a year at that time, on a H-1B)
- I got the approval for ETA750 A&B (labor certification) in June 04
and files for I-140 and I-485 in July 04, for me and my wife - we also
filed for I-765 and I-131 (work and traval authorizations) at the same
time
- we got approval for I-765 and I-131 in Aug 04
- I got the approval for I-140 in Jan 05 and we are now waiting for the
I-485
- we are with the Vermont service center
- we use as attorney an online service: VisaNOW.com, and I have only
good thins to say about the service there
- I do not know if it makes a difference, but I have a MS from France
and got an MBA in the USA - maybe that makes the approval things easier
/ faster?

If you have not come to the understanding yet that dealing with the INS is the same as gambling then you got a lot of learning to do still. I had an approved Labor cert with an ex-employer before, then I got laid off. Guess what? I had to re-do the whole thing with my new employer only this time it's slower. It took me 9 months before to get a Labor cert approved, now I am going on my 18th month. Whoever said that the immigration laws need to be revised was not joking...
