i-131 travel during adjustment of status
Hello,
I have a few questions about adjustment of status and travel. Currently, I am
awaiting receipt for filing for the adjustment of status papers.
1. If I didn't file I-131 along with my AOS, can I still file it? If so, what
document do I provide along with my I-131 to satisfty "evidence of eligibility"?
2. If I travel and am away from home, how will I be able to handle the fingerprint
appointment (for EAD I-765) and the interview appointment?
a. Do I need to have someone checking my mail for letters from the INS?
b. Can appointment time be rescheduled?
I've been reading the posts on I-131 and travel, but haven't found any information on
how to handle the logistics of the appointment processes while travelling.
Thanks in advance. Matthew Ma

You can still file for Advance Parole. You will need to wait for the AOS receipt -
you will include a copy of this receipt with you I-131.

Most offices give a general timeline for when an interview can be expected. You
should try not to plan a vacation during this time. Here is a website showing local
office processing times. http://members.aol.com/MDUdall/instimes.htm And it can be
helpful to have someone check you mail. If you miss an appointment, you application
could be considered abandonned. And yes appointments can be rescheduled, but it is
not recommended. Many who have posted about trying to reschedule have found there
requests were lost and they were presumed to have abandonned their applications, and
had some difficultly reschuduling an appointment, usually requiring the assistance of
an attorney or their congressperson.
