I-131.... Risky?

Default I-131.... Risky?

Is attempting to leave the US (by using I-131, Adv Parole) while your residency forms are pending a risky move?

Were pondering wether to go away at Christmas but if it means the border patrol closing the doors on me on the way back into the US, we may rethink the idea?

Hi:

It can be. There is one situation where I think use of advance parole improves one's legal situation, but I haven't seen case law or practice on it.

Generally people leave and return on AP and are just fine.

As Mr. F points out, there can be problems. As I remember, it puts you in a slightly weaker position - you are paroled into the country, rather than admitted.

I think the advice on the forum has usually been to not use it if you have anything questionable such as criminal history etc. and to not use it if you've ever had any overstays.

If your record is squeaky clean, I believe in general people have no problems. We were advised by our attorney that it would be fine for my husband to use his.

So I guess it's not no-risk, but is low-risk for people with a clean history.

Leaving the US is usually never the issue... it's getting back in to the US using A/P that causes issues. This has been explained to you in another thread... so I'm not sure why you think a whole new thread is going to give you other answers not already given.
