How long do I need to stay with my current employer?
Hi,
I am a Canadian citizen currently working in the US with a valid H1B visa.
I am trying to get a Green Card.
My sponsoring company has just filed an RIR. I will have been with this
company 2 years. The filing attorney says the RIR will take at least 12
months to be looked at. Sometime after, they can file the 485. That should
take another 18 months ...if all goes well....
I beleive the 485 has to be in the system for at least 6 months before I
can transfer my visa status with another company.
Is this true? Do I have alternatives? How long do I need to stay with this
company before I can move on?
My previous employer was a contractor. I was there for almost 2 years,, we
were just getting ready to file the 485. My contract could not renewed. I
ended up having to work for another employer and start my paperwork all
over again. I can't afford to do that again!
So any help, experience, recommendations...hell, even a beer to cry over!
..would be appreciated.
Thanks for reading

Yes and no. The rules are a bit complicated.
I added your question to my FAQ in the AOS section.

Ingo,
I checked your website and couldn't find this question in your AOS
section.... Is it there or just hiding in plain view!
But from the numbers for RIR processing and I485 processing, I guess I am
looking at least 30 months before I can take my visa status to a new
employer ... True?
Thanks again

http://www.kkeane.com/aos-faq.shtml, and then scroll down to the question
"I have an employment-based I-485 pending and was recently laid off. Can I
start with another employer?"

Yes, that sounds realistic.
