Hi,

I'm in the US on an H1B (18 months to go).

We are expecting a child which will be born in the US (this is good news) and want to
know if "it" will become a US citizen and if so if this affects the parents
eligability to a different status.

Any thoughts on where to get a advice and ratification of the rules?

thanks

Peter

If the child is born in the US then it is automatically a US citizen. This does not
affect your visa status in any way though.

Congratulations, your child will be a natural born citizen, as is entitled to every
child born on US soil, except for children of diplomats. Your child can even run for
presidency!!(only natural born US citizens can) Unfortunately this wont change your
eligibility for status, a child can only sponsor their parent when they are 21 yrs or
older. Maybe your company can sponsor you Goodluck

Yes.

No. A US citizen needs to be at least 21 before he or she can sponsor the parents.

Yes, when your child is 21 years old, then he/she can petition his/her parents to
immigrate to the US. See

http://www.ins.gov/graphics/services...ncy/family.htm for the eligibility.

He or she will automatically be a US citizen. This does not provide you any benefit
nor does it hurt you in any way, with regards to your resident status.

Your child would be able to sponsor you for permanent residency, but not until he or
she reaches age 21.
