Help Please on VWP/ESTA questions - Cruise Ship
Interesting scenario for some friends of mine, and I'm hoping you guys have some answers/views on the subject! I have done some digging and reading but as with so many questions haven't found anything close to a definitive answer yet. I do appreciate no-one can say for sure whether an ESTA will be granted, but all views/discussion welcome.
Two Australian citizens, both in their 50s, thinking of either a fly/drive holiday round parts of the US, or possibly a cruise from Aus to Hawaii.
One has a conviction for drunk and disorderly or disorderly conduct, back in the late 70s, the other has a shoplifting conviction from around the same time.
As far as I can tell the first is not a CIMT, but the second one is. So if they apply for ESTA then she may well be unsuccessful because of the shoplifting, and thus need to look at a B1/B2 (not sure which it is ) ?
If one/both can't travel on the Visa Waiver programme, then obviously they need a visa to land in the USA but then the thought came up that maybe they could do the cruise to Hawaii instead - but that led to them wondering, do they need ESTA to travel on a cruise ship even if they stayed on board and didn't go ashore. I know it sounds odd, going all that way and not going ashore but they are just exploring travel options. Would they need to get ESTA before boarding the ship?

That crime just means they cant use the VWP but have to instead get a visa. Just like millions of others. Some do not come from a country that is VWP eligible. Including me. Does that make me a threat? Only when you post stupid posts like that.

They wouldn’t be able to board without ESTA approval or a visa. They may well decide to stay on board but what if they are not given that option in an emergency? If the ship develops a problem where it is no longer able to sail and all passengers have to be taken ashore to hotels and to await flights home or onward then they would have a problem.

They need the relevant ESTA or visa to show the ship officials, before they get on board. They will not be allowed to board without all the necessary documentation.
