help the ins is accusing us of fraud!!

Default help the ins is accusing us of fraud!!

Hi I wonder if you can help.
we have been living and working in the us for five years and got a
work sponsered green card in september last year. Two days ago we
recieved a court appearance summons for fraud as the contest we were
not employed when we recieved are cards. The facts of the case are we
worked up till the end of august and are last pay check was aug 22nd
then there was a lull in my husbands job which just happened to fit in
with are appointment with the london consalar where we had our green
card interview on the 25th of september. We left the US and my
husbands boss assured him that he could finish his project when he
arrived back in oct So we flew to england a couple of weeks early to
spend time with our family and waited for the date to arrive.
Everything went well are company had to over night are package to us
two days before the interview as it arrived so late in the US. The
package included a signed afidavid from the attorney for our company
dated in september that we were employed at the time with the company.
Anyrate we flew back the beginning of oct to start back at work the
2nd week of october. when my husband called work on the friday to tell
them we were back ect. He was informed because of the economy people
were being let go and he was one of them. We were totally in shock and
didnt think much about are green card at the time my husband worked
for himself for 5 weeks then got another job in the same industry same
wages ect. Then we reiceved this letter. It appears that the ins had
called are company to check up weather we still worked there, and they
said no and gave aug 22 (our last pay date as are last day) so it
appears we just went off to our interview off are own bat and
basically lied to consalar offical in the UK. Now heres a question our
deportation attorney we have contacted is fairly certain she can get
them to drop the fraud charge maybe even before the trial. As we have
afidavid and a paper trail taking us right up till we flew back in oct
proving that we still employed. How ever she is not sure that they may
take the Green card off us as even though there was the promise of
work before we left and during our time in the uk she is not sure we
would lose it on the ground that we didnt go straight to work when we
arrived, do you have any insight into this?? Also if we do lose green
card status do we have to leave or can we appeal ect please reply we
are feeling unbelievable gutted by this turn of events. We are a
couple who only brush with the law was a traffic ticket 3 yrs ago
Fraud is a big jump for us!!!!!

if your company can issue a written clarification that would help. Maybe you
can ask them to say you were on vacation and had no way of knowing that you
were unemployed in absentia. If the company has a heart they should help you
straighten this out...

I would thin that the fraud charge would be easier to beat. keeping your green
card may be a tough one...

Does any one know the law concerning keeping green card?? I spend all
day yesterday at the library and the only thing mentioned was if you
stayed out of the country for longer than a year, or commiting a
serious crime. Does anyone know of any cases like ares where there was
redundance when we returned from the GC interview.??
