Hello everyone, I'm new here to this groub. It's my frist time to write here. Anyway, I
was denied an entry once. It was last month. I was on a vist visa. When i got to the POE
the guy there asked me the reason of my vist. I told him that I was visiting my
girlfriend. As soon as he heard that he sent me inside to talk to someone else. So i
talked to this guy and asked me the same question. I told him that i'm visting my
girlfriend who is having our baby soon. He asked me if i'm going to marry her I told him
no. I'm not planning to marry her yet. I just wanted to be with her when she will have the
baby. I was so honest with him. However, stupid me, I only had a one way ticket. The
reason I had a one way ticket is that because I always entered the US with a one way
ticket with a F1 visa. I thought it is the same with the visit visa. Therefore, he told me
to buy another ticket so they could let me enter. He alos told me that I have to stay
there for only three months. It was ok with me. I really wanted to see my girlsfriend so
bad and be with her when she will have the baby. However, i had no enough mondy to buy the
return ticket so they didn't let me enter. The inspector told me that i will not be
banned, but he can't let me enter. I felt so sad and scared. I don't wanna be banned. He
told me to get a K1 visa and get married it's the best thing to do. My girlfriend sent the
forms to the NSC already now. I'm still scared and worried though. I hope that i will not
be denied the k1visa because of that. The inspector said that i won't be denied a k1 visa.
I beleive him but i'm still worried. please Help!!

Don't worry. My now-husband came on a K1. He got his K1 visa a mere 5 months after getting
turned back at the airport. They didn't even ask us at all about the "incident" -
actually, I think it may have helped with getting the K1, because we had an official
document from the INS saying we should get a K1. (How can they deny you your K1 if they're
the ones telling you to get it, right? )

File for the K1, come over with it, get married and raise your child and live a
happy life.

Betastar still slightly worried about us going through Dulles again in a few weeks - this
time with the AP

No you won't be denied the K-1 because of this experience. But I am confused. If you
didn't have enough money to buy another ticket, how did you afford to buy the return
flight back to your country. Or perhaps, INS paid for your flight or the airlines?

When POE denies entry the airline company is responsible to take the passenger back to the
point of embarkation. This is the reason that the company has to make sure that the person
has the appropriate visa and an appropriate ticket for the visa. It is very unusual for an
airline company to issue a boarding pass to a person with a visitor's visa and a oneway
ticket. Here is an example of how volunteering unsolicited information at a POE
( abehaviour wrongly labelled as "honesty" in a previous chain as well as this one ) is
tantamount to a confession of stupidity and asking to be sent back.

A man wants to come and be with a girlfriend who is having their baby. He tells INS at POE
that he does not intend to marry her. Just wants to be at the birth of the baby. INS
attempts to foist marriage on this guy......and

This is NOT true. It is only the airline's responsibility if the passenger does not have a
valid visa to enter the country where the passenger is going. It is NOT the airline's
responsibility if the INS still doesn't let the person in - it is the individual's
responsibility.

Usually people have round-trip tickets if they're planning a round-trip (especially since
they are usually cheaper than one-way tickets, which was part of something I didn't quite
understand in the original post...) and usually if they are turned away at the POE the
airline will let the person use their return trip ticket for the first available seat
back without an extra charge, but even then the airline doesn't have to do that. They
could charge the fee for changing a ticket (most airlines charge $150 for this for
international flights) plus the difference in ticket price between what you already paid
for and the flight you're taking (which, it being a last-minute return, could be in the
thousands of dollars).

I will say that Lufthansa is nice and doesn't charge anything.

A man wants to be there for the birth of his baby, comes in with a tourist visa and a
one-way ticket telling the INS that he's there for the birth of his baby to his US Citizen
girlfriend with his one-way ticket and no, sir, I don't intend to stay...

Gets turned back and now wants to know if he will be able to get the
K1.

No - Betastar wants to reassure him that he can get the K1 he wants (provided there are no
other complications like a criminal history) and get on with his life.

He *did* intimate if not outright say that he *wanted* the K1 now.

Airline companies are liable, and that is the reason why they train their check-in staff
to be very alert for visas and suitable tickets that are appropriate for the visa that

They are happy that the alien has this ticket that they can take. If the alien had
nothing...no money, no return ticket. Then the airline simply eats the expense of taking
the slug back and "black lists" that passport number for better vigilance in future
check-ins.

Ain't it nice to be in a comfortable country flying their national airline ? I'd bet that
the original poster is a "nihonjin" flying the most customer flendry( no sic) airline.

A little patience and understanding could be warrented to the guy. Not all of us were born
with all this INS information ingrained into us. We all make mistakes, hopefully we learn
from them and that others won't judge us based upon those mistakes of the past.

Very easily. They are not the ones that process the K-1s. Nor make the determining factor
on whether a person gets one or not.
