Default H4 and work permit application

Hi there,
I have H1B and my wife lives with me and has H4, which puts her as a "legal
alien not allowed to work in US". I have been told that now immigration
sometimes grants working permits to people who have H4 visas.

Anyone with more info on that? If this is true, how to apply for such work
permit? How long it might take to get one and how much would it cost? Any
info would be greatly appreciated.

We might consider getting help of a knowledgeable immigration attorney, but
want to be aware whet to expect and how things are to be able to control the
situation.

H-4 cannot work

An H-4 can get a work permit on hardship grounds. This is tricky, though.
If you were below the poverty line your H-1 could never have been granted
in the first place. This is so much of a Catch 22, that I would be
surprised if anyone was ever successful.

No. She would have to qualify for an H1 on her own.

I don't think that a H4 would be allowed to work, I know I was not allowed to previously. Probably the only option would be if she could find someone to sponsor her for a H1B.

I am sorry to say, but forget about it. It is a kind of urban legend
an H4 holder being able to get a work permit. I heard the same two
years ago when my wife was sick of staying at home all day, and even
wrote to the INS asking for information about it (they didn't answer,
of course). From time to time, I heard some one stating that there is
a new law that allows H4 holder to work, but believe me that it has no
real grounds. An H4 has only the right to be a idle person in the US
system, unfortunately.

This legend resurfaced with the ability of L2s (dependents of L1s) to
get work permits a couple years ago.
