H1B Visa Stamping after I-140 filing/approval

Default H1B Visa Stamping after I-140 filing/approval

Hello,

I tried to search this group for answers and I did not find any.

My H1B visa extension is approved and vaild till 2008. Visa on my
passport has expired. I am planning to travel to India and hence I need
to get my visa stamped in my passport before re-entry into US.

My labor certification is approved and I am in the process of filing
I-140. I am planning to go to the US consulate in Chennai, India for
H1B visa stamping on my passport. I will have to answer YES to the
immigration petition question on form DS-156 (Item#36) since my I-140
will be filed/approved when I appear for the visa stamping interview.

Will this be a problem? Expressing immigration intentions while
appearing for non-immigrant visa stamping?

H1b allows dual intent, so no, no problem.
