h1b visa extension after six years

Default h1b visa extension after six years

Hi, I have been in h1b visa for six years, and my greencard PERM
processing started like 2 weeks ago. My h1 is expiring the end of this
month.

What will be my status after this expiration and what are the possible
options for me to switch to a different status?

Any help is appreciated.

AFAIK the H1b can be extended on a yearly basis whilst you await LC. However, this is something that needs to be put in motion by your employer.

1) your green card needs to have been "in process" for more than 365 days in
order for you to qualify for 1-year extensions.

2) The green card process is actual several steps. Some of those steps
count towards the 365-days, some don't.

You should check with your lawyers.

------------ If LC gets approved before you complete 6 years and PD for you is current then file I-140, I-485 and EAD. If eligible to file I-485 and EAD then EAD will take around 90 days. For work you need H1 or EAD in hand. I don’t see that you have enough time on H1
If PD is not current you can’t file I-485 and you will have no base to file H1 extension and you need to depart US.

--------- No LC pending more that 1-year and you will be completing 6 years end of this month so no H1 extensions. If you have been out of US in last 6 years then count those days, go to good lawyer with your passport so that lawyer can see the stamps of entry to US and you may be eligible to recapture the time spent out of US. If eligible then file H1 extension to recapture that time BEFORE your I-94 gets expired

There used to be a clause whereby the total number of days (spent outside
the country) must be more than 6 months (for the rule to apply). BTW
That's not the number of days for each trips, that the total number of days
for all the trips. So, if you made a total 4 trips of 2 month each, you
will be credited for 8 months. If you made 2 trips of 2 months each, that
counts as zero.)

I don't know if this has changed.
