Hi - just wondering if anybody could answer this one.......... I'm an engineer on an
H1B visa here and have just started playing in a band that performs about twice
monthly. - If I get paid for doing these performances, does that mean it would count
as a part-time job and therefore would I have to obtain a separate visa to be able to
do this???

thanks

Yes, you would be receiving money for working in the US. Therefore, you would,
technically, have to obtain a separate visa to do this legally. However, unless you
can show that you have "extraordinary ability" in music (demonstrated by letters from
other top musicians; articles reviewing your performances, a high rate of
compensation compared to other musicians, etc.), it is highly unlikely that you would
be able to obtain such a visa (this would be the "O-1" visa, a temporary,
nonimmigrant visa for persons of extraordinary ability; or a green card based on your
extraordinary ability as a musician).

Hope this is helpful.
