H1B is valid but VISA and I-94 are expiring

Default H1B is valid but VISA and I-94 are expiring

Hi,

I got H1B1 valid upto 0ctober 31, 2004 but Visa (from previous
company) and I-94 are expiring on Aug 01, 2003.

Can anybody suggest me what to do to get it corrected in my I-94 or to
extend my stay?

Your visa for a "previous company" and the I-94 that was issued with it are
not valid anymore since you are no longer in status with that visa
regardless of what the expiration date says.
The new one, I suppose, was issued to you due to another approved employment
petition, right? If it is, then you should go to to a Port of Entry that
issues I-94 to get a new one for your new status. You have to turn in the
old one.

Visa is nothing to do with the employer as long as it is valid and I
have valid H1B papers and working.

I got H1B from new company with a I-94 valid upto 2004. In the mean
time I went on vacation to my home country and came back. During that
time, the POE officer stamped my I-94 to be valid upto aug, 2003 based
on visa. I showed him my new H1B docs, but I think he didnt pay
attention and I too missed to check.

Actually it was amistake by POE officer (unintentional) and I didnt
check the date until recently on I-94.

My question is whether I can contact BCIS office for correction or
have to file for extension of stay. Or is there any other solution?

WRONG! Your H1B visa is tied in to the employer who petitioned you for that
particular visa. You CANNOT work for another employer other than the one who
petitioned you. If you decide to work for an employer other than the one who
petitioned you then you would be out of status and your visa would become
invalid, not to mention, you would be breaking the law.
Check the annotation on your visa for the petition number and the
petitioning employer.
