H1B Stamping, Additional Administrative Processing....help urgent !
This year I had come to india in month of October for my vacation and since my visa had expired in March 2002 (I94 was valid till March 2004) I had sent my documents to Chennai Consulate again for visa stamping. Now the consulate has returned my passport and documents stating the following.
" Wait for our office to contact you regarding your visa application. Your application requires additional administrative processing before any further action can be taken. We will call you when we reach your case to conclusion"
Can you please advise me about my case as I am really into difficult situation as I have my job , rented apartment and car waiting in for me US.
Its two months now and I am still waiting for their response.
What is this additional administrative processing they do?
Is the wait indefinite?
Any information from your side will be highly appreciated.
Eagerly waiting for your response

There are two possible reasons for this. Either, they are performing the
security check on you. Although India is not on the list of countries
subject to it, its proximity to Pakistan suggest that the consulate may on
a case-by-case basis submit you to the check.
The other possibility is that your case has been forwarded to the
antifraud division. Some cases are pulled at random and submitted there.
Unfortunately, in both cases the wait can be a while, maybe three or four
months.

I have been stuck in India for the same reason since July 30th. There
seems to be no end in sight currently. From what I have noticed this
is happening mostly in Chennai and Kilkata.

I now read several post, where some of you guys have to wait for your H1B visas a long time, up to several months. what I always wondered, is, how the company reacts to that. I mean, are they waiting for you to come? Do they have to wait, since they are the sponsor? Don't the consulate consider that you might loose your job due to the long waiting?

Most companies actually use premium processing for the initial H-1B, where
time matters. For extensions and transfers, it doesn't really matter
(much) how long the H-1B takes because the beneficiary can work before
approval.

Ingo,
We are talking about the h1-B Visa and not the petition. They are 2
separate things.

Ooops. My bad, you are right. I misread the original question. Sorry I
don't have a good answer!

Srandeep,
I was considering stamping in India because my H1 extension was
extended. I have'nt changed employeer since I came to US in Aug 2000.
One of my friends was also in my same situation (ie, he did'nt change
employeer, his papers were perfect, his degree was Masters in Computer
Application, his H1 was extended). He decided to do the stamping in
India and there was no problem at all !!! He got the passport within 7
days or so and he returned last week.
I am also wondering if a degree of non computer nature of the H1
holder has anything to do with this. Another of my friend, who is
struck in the stamping process in India (Chennai), was telling me that
it may be because of a change in employeer.
All the best, keep us posted !!!

Sarandeep,
My email address is [email protected].
Have you contacted other people who have been waiting or received
their Visas after a long wait? Has it shed any light on how long it's
been taking?
